HomeMy WebLinkAbout1710 - Construction of an Ocean Pier-NE-0 —�w A M 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 LAW OFFICES OF ROLAND THOMPSON 210 SPURGEON BUILDING SANTA ANA, CALIFORNIA RESOLUTION NO. 11 L o _ WHEREAS, the City Council of the City of Newport Beach has ordered published a Notice Inviting Bids for the furnishing of labor, materials, transportation and services for the construction of an ocean pier located at the southerly extension of Main Street and an ocean pier located at the southwesterly extension of McFadden Place, and other work incidental thereto, in the City of Newport Beach; and WHEREAS, it became necessary for the City Council of the city of Newport Beach, prior to the giving of said Notice referred to in the previous paragraph, to ascertain and determine the general prevailing rate of per diem wages and rages for legal holidays and overtime work in the locality in which the work of construction above mentioned is to be performed, and further, It became necessary to determine and ascertain the general pre- vailing rate of per diem wages for each craft or type of workman or mechanic needed to executer' the contract which will be awarded to the successful bidder, pursuant to said Notice Inviting Bids; and WHEREAS, prior to the giving of said Notice Inviting bids, the City Council of the city of Newport Beach, after due consideration and study, has ascertained and determined the pre- vailing rate of per diem wages and rates for legal holidays and overtime work inthe locality in which the work herein mentioned is to be performed, for each craft or type of workman or mechanic needed to execute the contract which will be awarded to the successful bidder pursuant to said Notice Inviting Bids. The hourly wage rate prescribed hereinabove is the per diem rate divided by the aforementioned number of hours constituting a working day. BE IT FURTHER RESOLVED that one and one –half (1i) times the prevailing rate herein determined shall be paid except watchmen, flagmen and other non – manual workers, for any working time more than eight (8) hours during any one (1) calendar day where such work is required in cases of extraordinary emergencies caused by fire, flood, or danger to life or property, and for time on Sundays and the seven (7) legal holidays, to –wit: New Year's Day, Memorial Day, Fourth of July, Labor Day, Armistice Day, Thaftgiving Day and Christmas. BE IT FURTHER RESOLVED that it shall be mandatory upon the Contractor to whom the contract is awarded, and upon any subconstractor under him, to pay not less than the said specified rates to all laborers, workmen and mechanics employed by them in the execution of the contract.
