WHEREAS,there has this day been presented to the City

Council of the city of Newport Beach a certain Contract dated
5
the 31st day of January,. 1940, by and between the Standard
6
Oil Company of California, therein referred to as "Seller" and
7
the City of Newport Beach therein referred to as "Buyer "; and
8
WHEREAS, said contract provides that the Seller will sell
9
to the Buyer for a period of one year from February 10, 1940
10
to February 9, 1941, approximately 35,000 gallons of gasoline,
to be delivered either by tank truc$ or in iron barrels, at the
11
option of the Buyer, said gasoline to be Seller's regular
12
commercial brands of Standard Ethyl, Standard and/or Flight
13
Gasoline, at the prices in said Contract set forth; and
14
WHEREAS, the City Council of the City of Newport Beach
15
deems that it is for the best interestsand advantage of said
16
City of Newport Beach that said gasoline be purchased from the
17
said Seller upon the terms, conditions and at the prices in
18
said contract set forth.

NOW, THEREFORE, BE IT RESOLVED: That the Mayor and
20
City Clerk of the city of Newport Beach be, and they are hereby
21
directed, instructed and authorized to execute said contract
22
in the name of and on behalf of the City of Newport Beach, and
23
the City Clerk is directed to deliver a duly executed copy thereof
24
to the Seller therein named.

I hereby certify that the above and foregoing Resolution
27
was duly and regularly passed and adopted by the City Council of
28
the City of Newport Beach at a regular meeting thereof on the 5th
29, day. of February, 1940, by the following vote, t . -wit:
