WHEREAS, there has this day been presented to the
4
City Council of the City of Newport Beach a certain lease dated
5
the day of 1940, by #}nd between the City
6
of Newport Beach therein designated as Lessor, and Roscoe L. Hart,
7
therein designated as Lessee; and

WHEREAS, the parties to said lease have heretofore
9
and on or about the 7th day of August, 1939, entered into a
10
certain agreement of lease covering the property described as
11
follows:

All that certain real property situated in the City
13
of Newport Beach, County of Orange, State of California, and more
14
particularly described as follows, to —wit:
The Easterly 25 feet of Lot 6, Block 218, as laid
15
out and shown upon a Map of Section A, Newport
Beach, recorded in Miscellaneous Maps, Book 4, page
16
21, Records of Orange County, California, and a
portion of Lot 4, Section 33, Township 6 South,
17
Range 10 West, S.B. B. & M., bounded on the south
by the northerly line ofsaid Lot 6, on the north
18
by the easterly extension of the northerly line of
Lot 4 in said Block 218, on the east by the north-
19
erly prolongation of the easterly line of said Lot
6, and on the west by the northerly prolongation
20
of the westerly line of Lot 8 in said Block 218.

And WHEREAS, it has been found that said description
22
is defective in that said property is shown on a Map of Section
23
"B" and is found in Book 4, page 27, instead of Book 4, page 21,
24
as shown by said description; and
25
WHEREAS, the parties to said lease desire to correct
26
said defective description by the entering into of a new lease
27
rather than amending the former lease.

NOW, THEREFORE, BE IT RESOLVED: That the lease this
29
day presented be, and the same Is hereby approved as written and
30
the Mayor and City Clerk ofthe city of Newport Beach are hereby
31
directed, instructed and authorized to execute said lease in the
32
name of and on behalf of the City of Newport Beach.

1 BE IT FURTHER RESOLVED: That when the lease herein
2 referred to shall have been executed by Roscoe L. Hart, and the
3 lease heretofore made, surrendered for cancellation, as herein -
4 after provided for, by the said Roscoe L. Hart,then the original
5 duplicate of said lease shall be delivered to said Roscoe L. Hart.
6 BE IT FURTHER RESOLVED that when all copies of said
7 old lease herein referred to shall be delivered up to the City
8 Clerk of the city of Newport Beach, the City Clerk is authorized
9 and instructed to cancel said leases on the face thereof, and
10 shall thereupon file the same for future reference.
