RESOLUTION NO. h
WHEREAS, there has this day been presented to the City
Council of the City of Newport Beach, a certain agreement, dated
the 3rd day of February, 1941, wherein the City of Newport Beach
is designated the party.of the first part and S. M. Spalding is
designated the party of the second part; and
WHEREAS, in the opinion and judgment of the City Council
said, agreement is in all respects fair and just, and the consider-
ations therein mentioned as passing between the respective parties
are in all respects adequate; and
WHEREAS, it is further the.judgment of the City Council
that it is for the best interests of said city that said contract
be executed in the form presented.
NOW, THEREFORE, BE IT RESOLVED: That the Mayor and City
Clerk of the City of Newport Beach be, and they are hereby in-
structed, authorized and directed to execute said contract in the
name-of and on behalf of the City of Newport Beach; and
BE IT FURTHER RESOLVED: That a duly executed copy of said
agreement be delivered to the said, S. M. Spalding, and the other
copy, thereof; filed in the records of the City Clerk of the City
of Newport Beach.
I hereby certify that the above and foregoing Resolution
was duly passed, adopted and approved by the City Council of the
City of Newport Beach at a regular meeting thereof held on the 3rd.
day of February, 1941.
