RESOLUTION NO.
WHEREAS, there has this day been presented to the
City Council of the city of Newport Beach a certain agreement
dated April 7th, 1941, by and between GORDON B.FINDLAY, party
of the first part, and CITY OF NEWPORT BEACH, party of the second
I part; and
WHEREAS, said agreement provides that the party of the
second part hires and retains the first party for the purpose of
furnishing any and all required labor, materials, transportation,
plant, tools and services for the construction of a storage garage
and office building and stucco wall and gate for said second party,
In the City Street Department Yard at 32nd Street and Lafayette
Avenue in the city of Newport Beach, in accordance with the plans
and specifications prepared by the City Engineer of the city of
Newport Beach and on file with the City Clerk of said city, for
the doing of said work of improvement, a copy of which snecifl.rat'-
is attached to said agreement and made a part thereof; and
WHEREAS, said agreement specifically sets forth the
terms, conditions and price for the doing of said work; and
WHEREAS, the City Council of the city of Newport Beach
deems that it is for the best interests of said city that said
agreement be executed, and that the work therein specified be done
by first party upon the terms and conditions therein set forth.
NOW, THEREFORE, BE IT RESOLVED: That the Mayor and
City Clerk of the City of Newport Beach be, and they are hereby
directed, authorized and instructed to execute said agreement
In the name of and on behalf of the city of Newport Beach, and
that the City Clerk furnish a duly executed copy thereof to the
party of the first part in said agreement named.
