UHERE.AS, the City Council of the City of Vevport Beech
on the 17th d =.y of Novembers 1941s *waned its Resolution of
Intention No. 2€06 to order the hereinafter improvement to be made
End public Mork to be done in the City of Netrrport Beach; and
I*MREAS, after the passage and adoption of Resolttion
of Intention No. 2506 the Street Superintendent of the City of
Ne *noort Beach caused to be conspicuously posted along the line
of the contemplated tmrk of improvement at not more than three
hundred (300) feet in distance apart, and twenty -two (22) in all,
noticee of the passage of said Resolution of Intention, headed
"NOTICE OF PUBLIC YORK ", in the manner, form and substance ea
required by lat,, and said Street Superintendent also caused a
notice similar in substance to be published by inserting said
notice for four successive times in the IMUPORT BALBOA PRESS, w
weekly newspaper published and circulated and of general
circulation in the City of Netroort B,-.ach, and named by said City
in said Resolution of Intention as the paper in *.-rhich slid notice
should appear, all as mDeara from the affidavit of If, H.
Ritchman, of the printers and publishers of said weekly newsoaner,
and which affidavit eras filed in the office of the Clerk of the
City of Me•port Beech on the 12th day of January, 1942, and is
note on file therein; and
I1HEREAS, the Street Superintendent of the City of
Netroort Beech commenced the posting of the notice hereinbefore
referred to on the 31st day of December, 1941, and fully
completed the costing thereof on the 31st day of December,

Assistant Street Superintendent of the City of Nernort Beach, and

more than ten (10) days having expired after the expiration of the
4
time of the`publioation of said notice within which protests or
5
objections to the proposed work of improvement might be made by
6
any person interested objecting to said work of improvement, or to
7
the extent of the district or lands to be affected or benefited by
8
said work of improvement and to be assessed to pay the costs and
9
expenses thereof; and
10
VMURMS, no oerean has filed vr2tten or made oral
11
objections to said work of improvement or to the extent of the
12
district_ or lands to be affected or benefited by said work of
13
improvement, and to be assessed to pay the costs and expenses
14
thereof, or made any written objections whatsoever regarding said
15
work of improvement; and
16
WHEREAS, more than ten (10) days have expired since the
17
publication of said notice of public work heretofore referred to
18
a.bd the City Council of the City of Newport Beach has now
19
acquired jurisdiction to order the said improvement.

IT IS HEREBY RESOLVED AFD ORDERED that the public
21

interest and convenience requires the work hereinafter described
23
and the City Council of the City of Newport Beach hereby orders
24
the following work to be done and Unrovement made in the City of
25
Newport Beach, as follows:

That the following described proportion of that certain
27
alley fifteen (15) feet in width, shown upon a map of Subdivision
28
of Block "C ", Fetroort Bay Mot, recorded in Book 5, page 25 of
29
Niscellaneous baps, Records of Orange County, California, be closed
30
up and abandoned, to —wit:

Beginning at the southwesterly corner of Lot 68,
as shoes upon said man of Subdivision of Block C;
thence easterly along the southerly line of scid
Lot 68 to the southeasterly corner of scid Lot 68;
thence southerly in a straight line to the north-
easterly corner of Lot 71, as shown on said map
of Subdivision of Block C; thence westerly in a
straight line to the northwesterly corner of Lot
69, as shown uaon said map of Subdivision of Block
C; thence northerly in a straight line to the point
of beginning.
RESERVING to the City of Newaoort Beach, the right,
privilege and easement of maintaining, operating,
repairing, constructing and reconstructing water
mains and pipe lines, and sewage mains and ripe
lines, under, in, over and along a six (6) foot strip
of land measured three (3) feet on either side of the
center line of said alley, tJith the further right,
privilege and easement of going in and upon said
described six foot strip of land and easement for the
purpose of maintaining, operating, repairing, con-
structing and reconstructing said pine lines.
All of which is more clearly shown on a certain map
a ^proved and adopted by the City Council of the City of Newroort
Beach for said abandonment by Resolution No• 2506 on the 17th day
of November, 1941.
That the public work and improvement to be made is for
of
the purpose of closing up and abandoning a portion /that certain
alley in the city of Newport Beach as hereinbefore described,
and for that reason no district is chargeable for costs in
connection therewith.
All of the herein proposed work shall be done in
pursuance of an act of the Legislature of the State of CFlifornia,
designated "Street Opening Act of 1889 ", and amendments thereto.
For further particulara reference is hereby made to
said Resolution of Intention No. 2506, which is dated the 17th
day of Movember, 1941, and on file with the Clerk of the City of
Newloort Beach.
