3 WHEREAS, THOMAS S. SMITH and HARRIETT M. SMITH,
4 husband and wife, have this day offered to the CITY OF NEWPORT
5 BEACH, the sum of $315.00 for Lot 72, Tract 682, Corona del Mar,
6 in the City of Newport Beach, as shown on a Map recorded in Book
7 20 page 19 of Miscellaneous Maps, records of Orange County,
8 California; and
9 WHEREAS, the said price is a fair and adequate price
10 as and for the purchase price of said lot; and
11 WHEREAS, THE City Council of the City of Newport Beach
12 deems that it is for the best interests of said City that said
13 property be sold for the said sum of $315,00; and
14 WHEREAS, the price offered is just, fair and adequate
15 and is not disproportionate to the real value of the property
16 above described.
17 NOW, THEREFORE, BE IT RESOLVED: That said property be
18 sold to the said Thomas S. Smith and Harriett M. Smith, husband
19 and wife, for the sum of $315,00, free and clear of all
20 encumbrances, subject to the second half of the taxes for the
21 fiscal year 1942 -43, and unpaid improvement assessments of record.
22 Also subject to conditions, restrictions and reservations of
23 record. The Mayor and the City Clerk are hereby authorized and
24 directed to execute and deliver a deed for said property to the
25 said parties upon receipt of the consideration above set forth.
26 BE IT FURTHER RESOLVED: That the sum of $78.75 be paid
27 to Gerald W. Ritchie, as and for his commission for the
28 negotiating of the sale of said real property to Thomas S. Smith
29 and Harriett M. Smith, as joint tenants, said sum being a fair
30 and reasonable commission to be allowed in said sale, and said
31 broker being a licensed realtor of the City of Newport Beach.

I hereby certify that the above and foregoing
Resolution was duly and regularly passed and adopted by the City
Council of the City of Newport Beach at an adjourned regular
meeting thereof held on the 18th day of January, 1943, by the
