RESOLUTION NO.
WHEREAS, Harold 0, Boyvey and Elizabeth D. Boyvey,
husband and wife as joint tenants, have this day offered to the
CITY OF NEWPORT BEACH, the sum of $900.00 for Lots 5 and 6,
Block 1, Seashore Colony and Lot 20, Block 29, First Addition
to Newport Heights, in the City of Newport Beach, as shown on
a Map recorded in Book 7, Page 25 of Miscellaneous Maps and
Book 4, Page 94 of Miscellaneous Maps, records of Orange County,
California; and
WHEREAS, the said price is a fair and adequate price
as and for the purchase price of said lot; and
WHEREAS, the City Council of the City of Newport Beach
deems that it is for the best interests of said City that said
property be sold for the said sum of $900,00; and
WHEREAS, the price offered is just, fair, and adequate
and is not disproportionate to the real value of the property
above described,
NOW, THEREFORE, BE IT RESOLVED: That said property
be sold to the said Harold 0, Boyvey and Elizabeth D. Boyvey,
husband and wife as joint tenants, for the sum of $900.00, free
and clear of all encumbrances, subject to the taxes for the
fiscal year 1945 -46. Also subject to conditions, restrictions
and reservations of record. The Mayor andth a City Clerk are
hereby authorized and directed to execute and deliver a deed for
the said property to the saiid party upon receipt of the con-
sideration above set forth.
BE IT FURTHER RESOLVED: That the sum of $150.00 be
paid to H. M. Lane, as and for his commission for the negotiating
of the sale of said real property to Harold 0. Boyvey &rid
Elizabeth D. Boyvey, husbandand wife as joint tenants, the said
sum being a fair and reasonable commission to be allowed in said
sale, and said broker being a licensed realtor of the City of
Newport Beach,

I hereby certify that the above and foregoing
Resolution was duly and regularly passed and adopted by the
City Council of the City of Newport Beach, at a regular
meeting thereof held on the 14th day of May, 1945, by the
following vote, to—wit:

I, MARGERY SCHROUDER, City Clerk of the City of Newport
Beach, California, do hereby certify that according to the records
of the City of Newport Beach filed and maintained in my office,
the foregoing Resolution No. 3176 was duly and
regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
the 14th day of May 19 45, by the following
