AREAS, there has this day been presented to the City
Council of the City of Newport Beach a certain indenture of lease
dated as of the 31st day of August, 19459 wherein the City of
Newport Beach is therein designated "Lessor ", and United States of
America is therein designated "Government ", and covering that
certain real property described as follows, to -wit:
Those certain parcels of land, partly improved and
partly unimproved, fronting on Newport Bay and
California State Highway, (U.3.Highway A -101)9
approximately one mile Southeast of the junotbn of
Newport Road and California State Highway in the
City of Newport Beach, County of Orange, State of
California and more particularly described as
follows:
PARCEL 1: Beginning at a point in the United States
Government Bulkhead line between Stations 129 and 130,
as said bulkhead line and stations are shown upon a
map of Newport Harbor, showing Harbor lines, approved
by the War Department May 2, 1936, which point of
beginning is two thousand (2000) feet from said sta-
tion 130; running thence North 610 01 West along said
bulkhead line 200 feet; thence North 290 01 East
132 feet. thence North 610 01 West 160 feet; thence
North 294 01 East 262 feet more or less, to an inter-
section with the Southerly line of the California
State Highway; running thence Easterly along the
Southerly line of said highway 385 feet, more or less,
to a point which bears North 29° 01 East from the
point of beginning; thence South 290 01 Vilest 520
feet, more or less, to the point of beginning,con-
taining approximately three (3) acres of land.
TOGETHER WITH improvements located thereon as follows:
(a) A one -story frame building containing
1100 square feet.
(b) A dook containing approximately 370 square
feet to which is connected three (3) pon-
toon -type finger piers containing a total
of approximately 2660 square feet.
Net area - 4130 square feet.
Also TOGETHER with right of ingress and egress over
City owned private roadway from California State High-
way (U.S.Highway A -101) to and along Bay frontage
portion of private roadway to above described property.
PARCEL 2: Beginning at a point in the United States
Government Bulkhead line between Stations 129 and 130,
as said bulkhead line and stations are shown upon a
map of Newport Harbor, showing Harbor lines approved
by the War Department May 2, 1936 which point of be-
ginning is Eighteen hundred (1800; feet from said
Station 130; running thence North 61® 01 West along
said bulkhead line 200 feet; thence Aorth 290 01 East

1 520 feet, more or less, to an intersection with
the Southerly line of the California State High-
t way (U.S.Highway A -101), ru#ning thence Easterly
along the Southerly line of said highway to a point
3 which bears North 290 01 East from the point of be-
ginning; thence Southerly along said line 29° 01 Bast
4 to the point of beginning, containing approximately
2 -1/3 acres of land;
5 Total area of land - 5-1/3 sores
Total area of improvements - 4130 square feet.

8 WHEREAS, the consideration offered for the execution of
9 said lease in favor of the Government is, in the opinion and
10 judgment of the City Council of the City of Newport Beach, fair,
11 just and adequate; and
12 WHEREAS, it is for the best interests of the City of New -
13 port Beach that said lease be executed in accordance with its
14 terms, covenants and conditions,
15 NOW, THEREFORE, BE IT RESOLVED that the Mayor of the
16 City of Newport Beach and the City Clerk thereof be authorized.
17 directed and instructed to execute said lease in quintuplicate in
18 the name of and on behalf of the City of Newport Beach.

21 I hereby certify that the foregoing Resolution was duly
22 and regularly passed and adopted by the City Council of the City
23 of Newport Beach at a regular meeting thereof held on the 4th
24 day of September, 1945, by the following vote, to-wit:
