HomeMy WebLinkAbout3244 - Tract 907 Alley Vacation-1- • 1 RESOLUTION OF INTENTION NO. 2 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING THEIR INTENTION TO ORDER THE 3 CLOSING -UP, VACATION, AND ABANDONMENT OF CERTAIN ALLEYS AND EASEMENTS FOR PUBLIC UTILITY PURPOSES IN TRACT NO. 907, PUR- 4 SUANT TO AND IN ACCORDANCE 1WITH THE "STREET VACATION ACT OF 1941 ". 5 6 The City Council of the City of Newport Beach, pursuant 7 to the provisions of the "Street Vacation Act of 194111, approved 8 May 13, 1941, Statutes of 1941, Chapter 250 and amendments thereto, 9 being Division 9, Part 3, Streets and Highway Code, does hereby 10 Resolve and Declare as follows: 11 Section 1. That the public interest and convenience requires the 12 closing -up and abandonment of certain alleys, and easements to the 13 City of Newport Beach for public utility purposes, Tract No. 907 14 in the City of Newport Beach, California, and it is the intention 15 of the City Council of the City of Newport Beach to order the 16 following described alleys. and easements to the City of Newport 17 Beach for public utility purposes in said city to be vacated, 18 closed up, and abandoned, to -wit: 19 ALLEY 20 All that certain alley as laid out and shown upon a Map of Tract No. 907 recorded in Book 28, pages 25 to 36 inclusive of 21 Miscellaneous Maps, records of Orange County, California, lying adjacent to lots 1143 to 1156 inclusive as shown upon said map of 22 Tract No. 907. 23 ALLEY 24 All that certain alley as laid out and shown upon a Map of Tract No. 907 recorded in Book 28, pages 25 to 36 inclusive of 25 Miscellaneous Maps, records of Orange County, California, lying adjacent to lots 1127 to 1142 inclusive and lot 1146 as shown upon 26 said map of Tract No. 907• 27 ALLEY • 28 All that certain alley as laid out and shown upon a Map of Tract No. 907 recorded in Book 28, pages 25 to 36 inclusive of • 29 Miscellaneous Maps, records of Orange County, California, lying to lots 1155 to 1177 inclusive adjacent as shown upon said map of 30 Tract No. 907• 31 ALLEY All that certain alley 20 feet in width, as laid out and 32 shown upon a Map of Tract No. 907 recorded in Book 28, pages 25 to 36 inclusive of Miscellaneous Maps, records of Orange County, Cali- -1- 1 fornia, extending between the Westerly prolongation of the Northerly line of lot 1175 of said Tract No. 907 and the Westerly prolongation 2 of a line parallel with the Northerly line of lot 1153 of said Tract No. 907, said line being 7.5 feet South of the Northwest corner of 3 said lot 1153. 4 EASEMENTS FOR PUBLIC UTILITIES 5 All those certain easements 4 feet in width dedicated to the City of Newport Beach for Public Utilties as shown upon a Map 6 of Tract Nol 907 recorded in Book 25, pages 25 to 36 inclusive of Miscellaneous Maps, records of Orange County, California, extending 7 across lots 1127.to 1155 inclusive, and lots 1155 to 1152 inclusive and along the Westerly ikide of lot 1153 of said Tract No. 907 ex- 8 tending 7.5 feet Southerly of the Northerly line of said lot 1153. 9 All portions of said alleys and easements to the City of Newport 10 Beach for public utility purposes to be vacated, closed up, and 11 abandoned, are more clearly shown on a certain map approved and 12 adopted by the City Council of the City of Newport Beach for said 13 vacation, closing up, and abandonment , by the Resolution dated 14 �' 2 October 1, 1945 and designated Resolution No. . Reference 15 is hereby made for further particulars as to the proposed vacation, 16 closing up, and abandonment of said alleys, to said map, and said 17 map pis). made a part of this Resolution to the same extent and pur- 18 pose as if the same were herein incorporated in full. 19 Section 2. That the proceedings for the closing up and abandonment 20 of the aforesaid alleys and easements to the City of Newport Beach 21 for public utility purposes, shall be had and taken, and the City 22 Council of the City of Newport Beach elects to proceed under the 23 ppovisions of the "Street Vacation Act of 1941" approved May 13,1941, 24 Statutes of 1941, Chapter 250 and amendments thereto, being Division 25 9, Part 3, Streets and Highway Code. 26 Section 3. The Street Superintendent of the City of Newport Beach 27 shall cause to be conspicuously posted along the line of the alleys 28 and easements to the City of Newport Beach for public utility pur- 29 poses proposed to be vacated, not less than 300 feet apart, but not 30 less than three in all, notices of the vacation of said alleys and 31 easements to the City of Newport Beach for public utility purposes. 32 Said notices shall state the passage of this Resolution of Intention -2- C� C, C� E STATE OF CALIFORNIA ) COUNTY OF ORANGE ) CITY OF NEWPORT BEACH) I, MARGERY SCHROUDER, City Clerk of the City of Newport Beach, California, do hereby certify that according to the records of the City of Newport Beach filed and maintained in my office, the foregoing Resolution No. 3244 was duly and regularly adopted, passed, and approved by the City Council of the City of Newport Beach, California, at a regular meeting of said City Council held at the regular meeting place thereof, on the 1st day of October , 1945 , by the following vote, to wit: AYES, COUNCILMEN: Allen, Stanley, Isbell, Reed, Hall NOES, COUNCILMEN: None ABSENT, COUNCILMEN: None Dated this 1st day of February 19 60 City Cler an EX-Officio Clerk o t e City Council, City of Newport Beach, State of California.
