I7 .sa RESOLUTION NOD 01O WHEREAS, the United States Coast Guard, San Pedro, California, has turned over to the City of Newport Beach the temporary custody of that certain boat or vessel known and de- scribed as Fireboat Bright No, 1, Official No. 241302; and WHEREAS, the City of Newport Beach has agreed to fully protect and save harmless the United States Government from any and all damage to the said boat and to any of its machinery, tools or equipment; and WHEREAS, the City of Newport Beach has further agreed with the United States Government that it will keep said boat, its equipment, tools, and machinery in good condition and repair, during the time which it may hold the temporary custody thereof, wholly without expense to the United States Government; and WHEREAS, the City of Newport Beach has further agreed that it will fully protect and save harmless the United States Government from any and all claims arising out of'or in any way connected with the operation and maintenance of said boat by said city during the time it shall be in its custody, as well as all claims arising out of any matter or thing whatsoever in reference to said boat during the time said boat shall be held in the custody of the City of Newport Beach; HOW, THEREFORE, BE IT RESOLVED that the City of Newport Beach covenants and agrees with the United States Government that while said Fire Boat Bright, No. 1 shall be in its temporary custody, that said city shall be liable and responsible for any and all damage to the boat and to any of its machinery, tools, or equipment; and agrees and covenants that it will keep said boat and its equipment, tools and machinery in good condition and re- pair during the time which said city may hold it, and wholly without expense to the United States Government; and that it will further fully protect and save harmless the United States Govern- -1- • i 9 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 LAW OFFICES OP ROL.AND THOMPSON 210 SPOPGEON BLDG. CALIF. a �x s ment from any and all olaims arising out of or in any way connected with the operation and maintenance of said boat and from any and all olaime of every nature, description or kind arising out of or connected with the operation, maintenance or oustody of said boat by the City of Newport Beaoh; AND BE IT FURTHER RESOLVED, and it is agreed with the United States Government, that the City only holds the temporary oustody of said boat in this Resolution mentioned, and that it wi promptly, upon request, return the boat, together with its tools, equipment, and machinery, to any person or department of the United States Government in good condition and repair; AND BE IT FURTHER RESOLVED that, in the opinion and judgment of the City Council, there is suffioient consideration passing between the City of Newport Beach and the United States Government in reference to the temporary custody of said boat a ffi for the agreements in reference thereto as set forth in this Resolution, in that said Fire Boat now furnishes fire protection to the City of Newport Beach and its tax payers insofar as Newport Harbor is oonoerned. AND BE IT FURTHER RESOLVED that a certified copy of this Resolution be forthwith sent by mail to Lt. Commander George Miohaud, United States Coast Guard, San Pedro, California, and that the original of this Resolution as passed be filed in the reoords and files of the City of Newport Beaoh by the City Clerk.
