L R % 0 WHEREAS, the City of Newport Beach, on the let day of October, 1945, passed a certain Resolution of Intention No. 3244, declaring its intention to order the closing up, vacation and abandonment of certain alleys and easements �i the City of Newport Beach for public utility purposes in Tract No. 907 in the City of Newport Beach, California, pursuant to and in accordance with the Street Vacation Act of 1941 approved May 13, 1941, Statutes of 1941, Chapter 250, being Division 9, part 3. Streets and Highways Code; and WHEREAS, the Street Superintendent of the City of Newport Beach has caused to be conspicuously posted along the line of said alleys and easements proposed to be vacated, not less than 300 feet apart, and not less than three in all, notices of the vacation of said alleys and easements, which said notices so posted stated the passage of said Resolution of Intention and the time and place of the hearing, all of which will more fully appear from the affidavit of S e Y V 2 9 , Street Superintendent, on file in these proceedings; and WHEREAS, the City Council of the City of Newport Beach, by said Resolution of Intention aftresaid, did fix Monday, the 5th day of November, 1945, at the hour of four o'clock P. M, of said day, in the Council Chambers of the City Council of the City of Newport Beach, located in the City Hall of the City of Newport Beach, as the time and place for the hearing of all persons interested in or objeoti ng to the proposed vacation of said alleys and easements; and WHEREAS, said hearing was regularly continued by the City Council of the Oit of Newport Beach on the 5th day. of Novem- ber, 1945, to the l� =day of �a h v a r`l , 194VL, at the hour of four o'clock P. M. Of said day, in the Council Chamber of the City Council, City of Newport Beach, located in the City Hall -1- .I L 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 of the City of Newport Beach as the time and place for hearing of fall persons interested in or objecting to the proposed vacation Of said alleys and easements; and WHEREAS, said Resolution of Intention No. 3244. afore- saidg has been published at least once in the Newport- Balboa News Timeev a newspaper of general circulation printed, published and circulated in the City of Newport Beach, and said publication was made before the date set for the hearing of all persons interested in or objecting to the proposed vacation, all of which will more fully appear by the affidavit of S. A. Meyer, printer and publisher of said Newport- Balboa News Times.on file in these proceedings; and WHEREAS$ the City Council has heard the evidence, both written and oral, by all persons interested in the vacation of said alleys and easements in this Resolution more particularly herein- after described, and finds from all the evidence submitted that sal alleys and easements described in the Resolution of Intention, and hereinafter described, She unnecessary for present or prospective for street purposes and are unnecessary for present or prospective easements for the use of said city; ROW, THEREFORE, the City Council of the City of Newport Beach finds and determines and hereby orders: That the following described alleys and easements in the City of Newport Beach, described as follows: ALLEY All that certain alley as laid out and shown upon a Flap of Tract No, 907 recorded in Book 38, pages 25 to 38 inclusive of Miscellaneous Mape, records of Orange County, California, lying adjacent to lots 1143 to 1156,-inolusive as shown upon said map of Tract ITO. 907. ALLEY All that certain alley as laid out and shown upon a Map of Tract No, 907 recorded in Book 28, pages 25 to 36 inclusive of Miscellaneous Maps, records of Orange County, California, lying adiaoent to lots 1127 to 1142 inclusive and lot 1146 as shown upon sad map of Tract No, 907. ALLEY All that certain alley 20 feet in width, as laid out and shown upon a Lisp of Tract No. 907 reoorded in Book 28, pages 25 to 38, inclusive of miscellaneous Maps, records of Orange County, Call fornia, extending between the Westerly prolongation of the Northerl line of lot 1178.of said Tract No. 907 and the Westerly prolonryatic of a line parallel with the Northerly line of lot 1183 of said Trac No. 907, said line being 7.5 feet South of the EQrthwest corner of said lot 1183. EASEMENTS FOR PUBLIC UTILITIES All those certain easements 4 feet in width dedicated to the City of Newport Beach for Publio'Utilities as shown upon a Map of Tract No. 907 recorded in Book 28, pages 25 to 36 inclusive of Miscellaneous Cups, records of Orange County, California, extending across lots 1127 to 1155 inclusive, and lots 1158 to 1183 inclusive and along the Westerly side of lot 1183 of said Tract No. 907 ex- tending 7.5 feet Southerly of the Northerly line of said lot 1183# are unnecessary for present or prospective public street purposes, and are wholly unnecessary for present or prospective public easements for public utility purposes or any other purpose or purposes, and now makes its order vacating said alleys and said easements. The City Council further finds and determines, and it Is hereby ordered that the public easement in the alleys heretofore described, and that the public easements for utilities purposes heretofore described, shall, and the Beane do hereby revert to the respective owners thereof, free from the public easement for street purposes or for public utility purposes or for any other purpose. The City Council further orders that the City Clerk of the City of Newport Beach shall cause a certified copy of this Order, duly attested by him as City Clerk under the seal of the City, to be recorded in the office of the County Recorder of Orange County, State of California, immediately following the LAW OFFICES OF ROLAND THOMPSON 270 SPURGEON BLDG.
