HomeMy WebLinkAbout3280 - Tract 907 Vacation1 • 2 3 4 5 6 7 • 8' 9 10 11 12 3 —il-yb ®PY RESOLUTION NO. 1280 RESOLUTION ORDERING VACATION WHEREAS, the City Council of the City of Newport Beach on the 7th day of January, 1946, passed a certain Resolution of Intention No. 3274 declaring its intention to order the closing - up, vacation and abandonment of certain alleys, streets and easements to the City of Newport Beach for public utility purposes in Tract No. 907 in the City of Newport Beach, California, pursuant to and in accordance with the 'Street Vacation Act of 194111, approved May 13th, 19419 Statutes of 1941, Chapter 250 and amend- ments thereto, being Division 9, Part 39 Streets and Highway Code; and WHEREAS, the Street Superintendent of the City of t Beach has caused to be conspicuously posted along the line 13 of said alleys, streets and easements to the City of Newport Beach 14 for public utility purposes, proposed to be vacated, not less than 15 300 feet apart, and not less than 3 in all, notices of the vacation 16 of said alleys, streets and easements to the City of Newport Beach 17 for public utility purposes, which said notices so posted stated the 18 passage of said Resolution of Intention and the time and place 19 of the hearing, all of which will more fully appear from the ` 20 affidavit of J. B. Webb, Street Superintendent, on file in these 21 proceedings; and 22 WHEREAS, the City Council of the City of Newport Beach, 23 by said Resolution of Intention aforesaid, did fix Monday, the 24 4th day of February, 1946, at the hour of 4:00 P. M. of said 25 day, in the Council Chambers of the City Council of the City of 26 Newport Beach, located in the City Hall of the City of Newport Beach 27 as the time and place for the hearing of all persons interested in 28 or objecting to the proposed vacation of said alleys, streets and 29 easements to the City of Newport Beach fmr public utility purposes; 30 and 31 32 1 WHEREAS, said Resolution of Intention No. 3274, aforesaid, • 2 has been published at least once in the Newport - Balboa News Times, 3 a newspaper of general circulation printed, published and cir- IMF 4 culated in the City of Newport Beach, and said publication was 5 made before the date set for the hearing of all persons interested 6 in or objecting to the proposed vacation, all of which will more 7 fully appear by the affidavit of S. A. Meyer, printer and publisher 8 of said Newport- Balboa News Times, on file in these proceedings; 9 and 10 WHEREAS, the City Council has heard the evidence, both 11 written and verbal, by all persons interested in the vacation of 12 said alleys, streets and easements to the City of Newport Beach 13 for public utility purposes, in this Resolution more particularly 14 hereinafter described, and finds from all of the evidence sub - 15 mitted that said alleys, streets and easements to the City of 16 Newport Beach for public utility purposes described in the Reso- 17 lution of Intention, and hereinafter described, are unnecessary for 1s present or prospective street purposes and public utility pur- 19 poses: 20 NOW, THEREFORE, the City Council of the City of Newport 21 Beach finds and determines and hereby orders: That the following 22 described portions of certain alleys, streets and easements to the 23 City of Newport Beach for public utility purposes in the City of 24 Newport Beach, described as follows: 25 1 VIA OPORTO 26 All that portion of Via Oporto as shown upon a map of Tract No. 907, recorded in Book 28, pages 27 25 to 36 inclusive, of Miscellaneous Maps, Records of Orange County, California, lying between the • 28 prolongation of the southerly line of Via Lido across said Via Oporto and the south line of said -- 29 Tract No. 907. 30 VIA MALAGA 31 All of Via Malaga, as shown upon a map of Tract No. 907, recorded in Book 289 pages 25 to 36 in- 32 clusive of Miscellaneous Maps, Records of Orange County, California 0 1 2 3 4 5 6 7'i 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ALLEY All that certain alley, 20 feet in width, as laid out and shown upon a map of Tract No. 907, re- corded in Book 289 pages 25 to 36 inclusive of Miscellaneous Maps, Records of Orange County, California, extending between the westerly pro- longation of a line parallel with the northerly line of Lot 1183 of said Tract No. 907, said parallel line being 7.50 feet south of the northwest corner of said Lot 1183 and the westerly prolongation of the south line of Lot 1192 of said Tract No. 907 ALLEY All that certain alley so feet in width, as laid out and shown upon a map of Tract No. 907, re- corded in Book 289 pages 25 to 36 inclusive of Miscellaneous Maps, Records of Orange County California, lying adjacent to Lots 1201 to 1208 inclusive, and lots 1211 to 1214 inclusive, of said Tract No. 907. EASEMENTS All those certain easements 4 feet in width, dedi- cated to the City of Newport Beach for public utility purposes, as shown upon a map of Tract No. 907, recorded in Book 28, pages 25 to 36 in- clusive, of Miscellaneous Maps, Records of Orange County California, extending across Lots 1184 to 1196 inclusive, and Lots 1205 to 1214 inclusive, and along the westerly side of Lot 1183, extending between a line parallel with and 7.5 feet south of the northerly line of said Lot 1183 and the south line of said Lot 1183, and along the south line of Lot 1184 and along the east line of Lot 1195 of said Tract No. 907. public e unnecessary for present or prospective /street purposes public utility purposes, and now makes its Order Vacating said lleys, streets and easements to the City of Newport Beach for public utility purposes. The City Council further finds and determines and it is hereby ordered that the public easements in the alleys, streets and easements to the City of Newport Beach for public utility purposes heretofore described have, upon the passage of this Resolution, ceased, and the title to said land herein described shall, and the same does hereby, revert to the respective owners thereof, free from the public easements for street purposes and public utility purposes. • Awk W • 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 The City Council further orders that the City Clerk of the City of Newport Beach shall cause a certified copy of this order duly attested by him as City Clerk under the seal of the City to be recorded in the office of the County Recorder of Orange County, State of California, immediately following the passage of this Resolution. The above and foregoing Resolution No. 3280 was passed at a regular meeting of the City Council of the City of Newport Beach, held on the 4th day of February, 1946, by the following vote, to -wit: C Recorded March 11, 1946 in Book 11+00, Page 189, Official Records of Orange County, California.
