HomeMy WebLinkAbout3434 - Vacating Alleys in CdM4. 1 RESOLUTION NO. • 2 RESOLUTION ORDERING VACATION 3 WHEREAS, the Street Superintendent of the City of New - • 4 WHEREAS, the City of Newport Beach on the 10th day of 5 February, 1947, passed a certain Resolution of Intention No. 3421, 6 declaring its intention to order the closing up, vacation and 7 abandonment of certain alleys in Block A -37, in Corona Del Mar, 8 in the City of Newport Beach, pursuant to and in accordance with 9 the "Street Vacation Act of 194111, approved May'13, 1941, Statutes 10 1941, Chapter 250 and amendments thereto, being Division 9, Page 11 1 3, Chapters 2 and 3, Sections 8320 to 8331, inclusive, Streets 12 and Highways Code; and 13 WHEREAS, the Street Superintendent of the City of New - 14 port Beach has caused to be conspicuously posted along the line 15 of said alleys, not more than 300 feet apart, and not less than 16 three in all, notices of the vacation of said portions of said 17 alleys, all of which will more fully appear from the Affidavit of 18 � L. V .Q ggerr the Street Superintendent of said , 19 City of Newport Beach, on file in these proceedings; and 20 WHEREAS, said notices so posted by the Street Superin- 21 tendent of the City of Newport Beach, stated the passage of said 22 Resolution of Intention No. 3421, aforesaid, and the date and 23 place of the hearing of all persons interested in or objecting to 24 the proposed vacation of said portions of said alleys; and 25 WHEREAS, the City Council of the City of Newport Beach, 26 by said Resolution of Intention aforesaid, did fix Kondb , the 10t 27 day of February, 1947, at the hour of four o'clock P.M. of said 28 day, An the Council Chambers of the City Council of the City of • 29 Newport Beach, located in the City Hall of the City of Newport 30 Beach, as the time and place for the hearing of all persons 31 interested in or objecting; to the proposed vacation of said 32 portions of said alleys; and LAW OFFICES OF -1- ROLAND THOMPSON 205 SPUR GEON BLDG. ' • 74 0 0 a 1 AREAS, said Resolution of Intention No. 3421 afore - 2 said has been published at least once in the Newport Balboa ~ 3 41±rms, a weekly newspaper of general circulation printed, pub - 4 lished, and circulated in the City of Newport Beach, and said 5 publication was made more than fifteen days before the date set 6 for the hearing of all persons interested in or objecting to the 7 proposed vacation, all of which will more fully appepr by the 8 affidavit of !\.lei �e�,� ;,,� tp °printer and publisher of said 9 Newport Balboa _. s on file in these wp , proceedings; and 10 WHEREAS, the City Council has heard the evidence, both 11 written and verbal, by all persons interested in the vacation of 12 said portions of said alleys in this Resolution more particularly 13 hereinafter described, and finds from all the evidence submitted 14 that said portions of said alleys described in the Resolution of 15 Intention, and hereinafter described, are unnecessary for present 16 or prospective alley or street purposes; 17 NOW, THEREFORE, the City Council of the City of Newport 18 Beach finds and determines and hereby orders: That the following 19 described portions of certain alleys in the City of Newport Beach,. 20 described as follows: 21 All of that alley 14 feet in width and that alley 22 12 feet in width in Block A -37, as shown upon a map of Corona Del Mar recorded in Miscellaneous Map Book 3, 23 Pages 41 and 42, records of Orange County, California, and more particularly described as follows: 24 25 26 27 28 29 30 31 32 Beginning at the most northerly corner of Lot 8 of said Block A -37, thence northeasterly on a direct line to the most westerly corner of Lot 10 of said Block, thence southeasterly along the southwesterly line of said Lot 10, to the most southerly corner thereof, thence northeasterly along the southeasterly line of Lots 10, 12, 14 and 16 of said Block to the most easterly corner of Lot of said Lot 16, thence on a direct line to the most northerly corner of Lot 15 of said Block, thence Southwesterly along the northwesterly line of Lots 15, 13, 11 and 9 to the most westerly corner of said Lot 9, thence south- easterly along the southwesterly line of said Lot 9 to the most southerly corner thereof, thence south- westerly on a direct line to the most easterly corner of Lot 1 of said Block, thence northwesterly along the northeasterly line of Lots 1, 2, 3, 41 51 61 7 and 8 LAW OFFICES OF ROLAND THOMPSON —2 208 SPUBGEON BLOO. C.LI P. to the point of beginning, s are unnecessary for present or prospective public alley or street purposes and now makes its order vacating said portions of said alleys described. The City Council further finds and determines, and it is hereby ordered, that the public easement in the portions of said alleys heretofore described has, upon the passage of this Resolution, ceased, and the title to the lands herein described shall, and the same does hereby revert to the respective owners thereof, free from the public easement for alley or street purposes, The City Council further orders that the City Clerk of the City of Newport Beach shall cause a certified copy of this order, duly attested by him as the City Clerk, under the seal of the City, to be recorded in the office of the County Recorder of Orange County, State of California, immediately following the passage of this Resolution.
