WHEREAS, there has this day been presented an agreement
between City of Newport Beach, as Licensor, and W. J. Carden, as
Licensee, covering the installation and maintenance of a telescope
on the Balboa Pier, to and including June 30, 1948, upon the terms,
covenants and conditions of said agreement mentioned, and upon the
rental therein stated; and
VAIERF.AS, the City Council believes that the consideration
offered for said agreement is just and adequate and that it is for
the best interests of said City that said agreement be signed;
NOW THEREFORE BE IT RESOLVED: That the Mayor and City
Clerk of the City of Newport Beach be, and they are hereby direct
authorized and instructed to execute said Agreement on behalf of
the City of Newport Beach, in duplicate, and that a copy thereof
be delivered to the Licensee upon his signing both copies of said
agreement, and the original thereof deposited by the Clerk in his
files and records.
I hereby certify that the foregoing Resolution was duly and
regularly* passed and adopted by the City Council of the City of
Newport Beach at a regular meeting thereof held on the 19th day of
January, 1948, by the following vote, to -wit:

the City of Newport Beach, California, at a regular meeting of
