Municipal Water District, a munieipal corporation; and
WHERUS, there is at present no connection for the service of water
from the Metropolitan dater District to the City of Newport Beach; and

HOW TE71MYORE BE 17 IMSCLYED by the City of Newport Beach,
that request is hereby msdo of the Coastal *=Icipal Water District to enter
into an agreement for the construction by the Metropolitan Water District of
Southern California, in accordam a \wick plans and specifications approved by
its General Manager and Chief Ingineer, and subject to his approval of the
construction thereof, of a connection to be located on the 21 inch line of
the Orange County feeder extension, about 6;400 feet southerly of the
Hetropolitan Water District of Saathern California's Corona del Mar reservoir,
through which service of Colorado River water will be available to the City
of Newport Beach, the construction and maintenance of said service connection
to be subject to the following:
(a) Said connection shall be used at such times as will not be
required for the delivery of water to other areas of Coastal Municipal Water
District.
(b) The use of said connection shall be in accordance with the
provisions of the Metropolitan Water .District Act and the rules and regalatio
of the Metropolitan Water District governing such service, and in accordance
with the provisions of the agreement entered into between the City of Newport
Beach and Coastal Municipal Water District governing the furnishing of water.
(c) The City of Newport Beach will deposit with Coastal Municipal
Water District the aim of $12,000.00,which is the estimated cost of oonstrucl
said connection, it being understood and agreed that if the cost of construel
is less than said sum, then the amount remaining in the hands of Coastal
Minicipal Water District shall be returned to the City of Newport Beach, and
if such cost exceeds said sum, then the City of Newport Beach will pay to
Coastal Municipal Water District the sum necessary to mert the cost of such

(d) Any oharge incurred by Coastal Municipal Slater District,
including the services of its Engineer, appertaining to the construction of
said connection, shall be included as a ,art of tke cost of the construction.
The above and foregoing Resolution was duly passed and adopted
at a regular meeting of the City Council, of the City of Newport Beach,
held on the 28th day of February, 1949, by the following vote, to wit:
