1 <br />• 2 <br />• 3 <br />41 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />29 <br />30 <br />31 <br />32 <br />C O P Y / <br />`J <br />RESOLUTION N0. 3755 <br />RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF NEWPORT BEACH, CALIFORNIA, <br />ADOPTED PURSUANT TO THE REQUIREMENTS <br />OF THE "SPECIAL ASSESSMENT INVESTIGATION, <br />LIMITATION AND MAJORITY PROTEST ACT OF <br />1931 ", BEING PART 2, DIVISION 4 OF THE <br />STREETS AND HIGHWAYS CODE OF THE STATE <br />OF CALIFORNIA. <br />WHEREAS, the City Council of the City of Newport Beach, <br />California, having heretofore instructed the City Engineer in the <br />matter of the proposed grading, paving, construction of cement curb; <br />sanitary sewers, water mains, fire hydrants, drainage structures, <br />wooden guard rail and appurtenant work in a portion of Ocean Boule- <br />vard (Corona Del Mar) and easements, to procure the data and preparc <br />a written report pursuant to the provisions of the "Special <br />Assessment Investigation, Limitation and Majority Protest Act of <br />1931 ", being Part 2, Division 4 of the Streets and Highways Code <br />lof the State of California, and thereafter the said City Engineer <br />.presented to this City Council the said written report; and <br />WHEREAS, pursuant to the provisions of said Part 2, <br />Division 4 of the said Streets and Highways Code, the City Council <br />shall, by resolution or ordinance, determine in general the nature, <br />location and extent of the proposed improvement; generally define <br />the boundaries or extent of the district or lands to be specially <br />assessed to pay the costs thereof, or any part of such costs; and <br />determine the statute under which it is proposed to conduct the <br />proceedings for such improvement and for the issuance of bonds <br />therein, if any. <br />NOW, THEREFORE, BE IT RESOLVED AND DETERMINED by the City <br />Council of the City of Newport Beach, California, as follows: <br />- 1 - <br />
