HomeMy WebLinkAbout3755 - Ocean Boulevard Improvements - Corona del Mar1 • 2 • 3 41 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 C O P Y / `J RESOLUTION N0. 3755 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, ADOPTED PURSUANT TO THE REQUIREMENTS OF THE "SPECIAL ASSESSMENT INVESTIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931 ", BEING PART 2, DIVISION 4 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA. WHEREAS, the City Council of the City of Newport Beach, California, having heretofore instructed the City Engineer in the matter of the proposed grading, paving, construction of cement curb; sanitary sewers, water mains, fire hydrants, drainage structures, wooden guard rail and appurtenant work in a portion of Ocean Boule- vard (Corona Del Mar) and easements, to procure the data and preparc a written report pursuant to the provisions of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931 ", being Part 2, Division 4 of the Streets and Highways Code lof the State of California, and thereafter the said City Engineer .presented to this City Council the said written report; and WHEREAS, pursuant to the provisions of said Part 2, Division 4 of the said Streets and Highways Code, the City Council shall, by resolution or ordinance, determine in general the nature, location and extent of the proposed improvement; generally define the boundaries or extent of the district or lands to be specially assessed to pay the costs thereof, or any part of such costs; and determine the statute under which it is proposed to conduct the proceedings for such improvement and for the issuance of bonds therein, if any. NOW, THEREFORE, BE IT RESOLVED AND DETERMINED by the City Council of the City of Newport Beach, California, as follows: - 1 - C O P Y 1 1. That the written report presented by the City Engineer • 2 for the proposed improvement herein referred to is hereby approved, • 3 and it is ordered that the said report be filed in the office of 4 the City Clerk for public inspection. 5 2. That the proposed improvement herein mentioned is 6 described as: 7 (a) The grading, paving with plant mix material, 8 construction of cement concrete curb, sanitary sewers, water mains, 9 fire hydrants, drainage structures, wooden guard rail and appurtenan 10 work in connection therewith; in 11 OCEAN BOULEVARD 12 between a line approximately 150 feet Northwesterly from and paralle 13 with the Southwesterly prolongation of the Northwesterly line of 14 Marguerite Avenue and a line approximately 40 feet Northwesterly 15 from and parallel with the Southwesterly prolongation of the North- 16 westerly line of Poppy Avenue. 17 (b) The construction of corrugated metal pipe storm 18 drain and appurtenant work in that certain public 19 EASEMENT 20 over and across Lot 15 of Tract No. 1026, as per map recorded in 21 Miscellaneous Map Book 33, Pages 37 and 38, records of Orange County 22 California; and in that certain public 23 EASEMENT 24 over and along the Southeasterly side of Lot 4 of Tract No. 1257, 25 as per map recorded in Miscellaneous Map Book 38, Page 23, records 26 of said County; and in that certain public 27 EASEMENT 28 over and along the Southeasterly side of Lot 12 and the Northwester - 29 ly side of Lot 13 of said Tract No. 1257. 30 I 3. That all of the said work and improvement, proposed 31 to be done, shall be constructed along the lines, between the points 32 and at the places shown on the plan prepared by the City Engineer -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 181' 19 20 21 22 23 24 25 26 27 28 29 30 31 32 C O P Y loLf of said City, consisting of one sheet, filed with the said report and by this reference made a part hereof. 4. That the district or lands to be specially assessed to pay the costs of said proposed improvement is shown upon the map, consisting of one sheet, filed with and forming a part of said written report. Reference is hereby made to said map for a further, full and more complete description of said assessment district, and the said map so on file shall govern for all details as to the extent of said assessment district. 5. That the proposed improvement shall be done under the provisions of the "Improvement Act of 1911 ", being Division 7 of the Streets and Highways Code of the State of California. 6. That serial bonds, bearing interest at the rate of six per cent (690) per annum, and extending over a period ending nine (9) years from the second day of January next succeeding the next October fifteenth following their date, shall be issued hereunder in the manner provided by the said "Improvement Act of 1911 ", being Part 5, Division 7 of said Streets and Highways Code, to represent each assessment of Twenty -five Dollars ($25.00) or more, remaining unpaid for thirty (30) days after the date of recording the assessment warrant. 7. That the said City Council hereby fixes Monday, the 27th day of February, 1950, at the hour of seven - thirty o'clock j (7:30) P.M. as the date and hour, and the Council chamber of the City Council in the City Hall of said City as the place of hearing on the written report of the City Engineer, and hereby such hearing to be held by the City Council of said City..
