HomeMy WebLinkAbout3777 - Alley Improvements btw 11th & 19th Streets1 • 2 • 3 4 5 6 7 8'i 91 10 11 12 13 14 15 NX:l 17 18 19 20 21 22 23 24 25 26 27 • 28 • 29 30 31 32 COPY 01 RESOLUTION NO. 3777 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, ADOPTED PURSUANT TO THE REQUIREMENTS OF THE "SPECIAL ASSESSMENT INVESTIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931 ", BEING PART 2, DIVISION IV OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA. WHEREAS, the City Council of the City of Newport Beach, California, having heretofore instructed the City Engineer in the matter of the proposed improvement of certain alleys between Elevenl Street and Nineteenth Street to procure the data and prepare a written report pursuant to the provisions of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931 ", being Part 2, Division IV of the Streets and Highways Code of the State of California, and thereafter the said City Engineer presented to this City Council the said written report; and WHEREAS, pursuant to the provisions of said Part 2, Division IV of the said Streets and Highways Code, the City Council shall, be resolution or ordinance, determine in general the nature, location and extent of the proposed improvement; generally define the boundaries or extent of the district or lands to be specially assessed to pay the costs thereof, or any part of such costs; and determine the statute under which it is proposed to conduct the pro- ceedings for such improvement and for the issuance of bonds therein, if any. NOW, THEREFORE, BE IT RESOLVED AND by the Cit (Council of the City of Newport Beach, California, as follows: 1. That the written report presented by the City Engin- leer for the proposed improvement herein referred to is hereby and it is ordered that the said report be filed in the office of de City Clerk for public inspection. 2. That the proposed improvement herein mentioned is described as: - 1 - 0 C� J • C 0 P Y 1 (a) Grading, paving with plant mix material, installat' 2 of house sewer and water connections and appurtenant work in connec- 3 tion therewith; in the first 4 ALLEY 5 lying Northerly from Balboa Boulevard, between Eighteenth Street an 6 Nineteenth Street; and in the first 7 ALLEY 8 lying Southerly from Balboa Boulevard, between Eleventh Street and 9 Thirteenth Street, and between Fourteenth Street and Fifteenth 10 Street, and between Nineteenth Street and the first alley lying 11 West of Fifteenth Street. 12 (b) Grading, paving with plant mix material, installa- 13 tion of water connections and appurtenant work in connection there - 14 with; in the first 15 ALLEY 16 lying Northerly from Balboa Boulevard, between Eleventh Street and 17 Twelfth Street, and between Thirteenth Street and Fifteenth Street. 18 (c) The construction of cement concrete alley approache 19 or aprons at the following locations, to -wit; in the Westerly side o 20 ELEVENTH STREET 21 at its intersection with the first alley lying Northerly from Balboa 22 Boulevard; and in the Easterly side of 23 TWELFTH STREET 24 at its intersection with the first alley lying Southerly from Balboa 25 Boulevard; and in 26 THIRTEENTH STREET 27 along the Easterly side thereof, at its intersection with the first 28 alley lying Southerly from Balboa Boulevard, and along the Westerly 29 side thereof at its intersection with the first alley lying Northerl 30 from said Balboa Boulevard; and in the Westerly side of 31 FOURTEENTH STREET 32 at its intersection with the first alley lying Southerly from Balboa Boulevard; and in the Easterly side of - 2 - �u 6 lJ • C 0 P Y 1 FIFTEENTH STREET 2 at its intersection with the first alley lying Southerly from Balbo< 3 Boulevard; and in the Easterly side of 4 SIXTEENTH STREET 5 at its intersection with the first alley lying Southerly from Balbo< 6 Boulevard; and in the Easterly side of 7 NINETEENTH STREET 8 at its intersections with the first alleys lying Northerly and 9 Southerly from Balboa Boulevard. 10 (d) The furnishing of 115 feet of corrugated metal pips 11 for storm drain to be constructed by the City in that certain 12 EASEMENT 13 along the Easterly side of Lot 22, Block 14, Section B, Newport 14 I Beach. i 15 3. That all of said work and improvement, proposed to 16 be done, shall be constructed along the lines, between the points 17 and at the places shown on Map No. 429, consisting of three sheets, 18 filed with said report and by this reference made a part hereof. 19 4. That the district or lands to be specially assessed 20 to pay the costs of said proposed improvement, is shown upon Map 21 No. 429 consisting of three sheets, filed with and forming a part 22 of said written report. Reference is hereby made to said map for 23 further, full and more complete description of said assessment 24 district, and the said map so on file shall govern for all details 25 I as to the extent of said assessment district. 26 5. That the proposed improvement shall be done under 27 the provisions of the "Improvement Act of 1911 ", being Division VII 28 of the Streets and Highways Code of the State of California. 29 6. That serial bonds, bearing interest at the rate of 30 six per cent (6/) per annum, and extending over a period ending 31 nine (9) years from the second day of January next succeeding the 32 next October fifteenth following their date, shall be issued here- under in the manner provided by the said "Improvement Act of 1911 ", being Part 5, Division VII of said Streets and Highways Code, to 3 - � ?4 9 C] • • IICOPY I,c� 1 2 3 4 5 6' 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 represent each assessment of Twenty -five Dollars ($25.00) or more, remaining unpaid for thirty (30) days after the date of recording the assessment warrant. 7. That the said City Council hereby fixed Monday, the 24th day of April, 1950, at the hour of seven - thirty o'clock (7:30) P.M. as the date and hour, and the council chambers of the City Council in the City Hall of said city as the place of hearing on the written report of the City Engineer, and hereby orders such hearing to be held by the City Council of said City.
