HomeMy WebLinkAbout3807 - Sanitary Sewer Construction1 • 2 • 3 4 5 6 7 8 9 10 11 12 13, 14 15I 16 17 18' 19 20'', 21'. 22 23' 24 25 26 27 • 28 • 29 Kiel 31 32 C 0 P Y RESOLUTION NO. 3807 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, ADOPTED PURSUANT TO THE PROVISIONS OF SECTION 2808 OF THE "SPECIAL ASSESSMENT INVESTIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931 ", DIVISION 4 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA. WHEREAS, the City Council of the City of Newport Beach, California, has received a communication from the Health Officer of Orange County (who also acts as Health Officer in the City of Newport Beach under an agreement with said County), and which communication is in words and figures as follows: I To the Honorable City Council City of Newport Beach, California. Gentlemen: January 6, 1950 As Health Officer of the City of Newport Beach and of the County of Orange, I hereby recommend that proceedings be instituted at once for the construction of sanitary sewers in that portion of Newport Beach bounded on the East by the alley between 42nd and 43rd Sts., on the North by the boundary of the old Santa Ana River channel, on the West by 50th St. and on the South by the Pacific Electric Right of Way, as outlined in plans on file in the office of the City Engineer. This recommendation is made as a measure necessary for the protection of public health and is also made pursuant to Section 2808 of the Streets & Highways Code of the State of California. We have made an investigation of the sanitary conditions in this area of the city and found that residents therein have been, and are experiencing difficulties with their individual sewage disposal systems. The difficulties in this area are due to the high water table common throughout the area and the leases of oil that are frequently encountered. These two factors alone will hinder the proper operation of the individual disposal systems. Yours very truly, (signed) Edw. " E • 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18� 19 20 21 22 23 24 25 26 27 28 29 30 31 32 C 0 P Y AND, WHEREAS, the City Council has duly considered the said communication, and has received information from the City Engineer with reference to the proposed sewer improvements, referred to in said communication: NOW, THEREFORE, THE CITY COUNCIL OF THE .CITY OF NEWPORT BEACH, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, FIND, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the improvements referred to in said communi- cation above quoted, are the construction of sanitary sewer mains and appurtenant work in connection therewith in Balboa Boulevard and other streets and public property, together with certain county roads over which consent has been granted by a resolution of the Board of Supervisors of the County of Orange, all as particularly shown and delineated on Plans and Profiles No. 431, consisting of S sheets, heretofore approved by the City Council and now on file in the office of the City Engineer of said City. SECTION 2. That said City Council does hereby find and determine that the construction of said sanitary sewer mains and appurtenant work in connection therewith, and each of them, is necessary as a health measure and such necessity for such construction is found to exist. SECTION 3. That the City Clerk is hereby authorized and instructed to spread the contents of said original communicath n upon the minutes of this meeting of the said City Council, at which this resolution is adopted: SECTION 4. That this resolution is adopted under and pursuant to the provisions of Section 2808 of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931 ", Division 4 of the Streets and Highways Code of the State of California, and the City Council in adopting the same intends to meet each and every condition and to make each and every finding necessary on its part in order to permit the proceedings for said 2 C 0 P Y 18 19 20 21 22 23 24 25 26 27 0 28 • 29 30 31 32 3 1 sewer improvements to go forward to completion without further • 2 reference to or application of the provisions of said Division 4 • 3 of said Streets and Highways Code. 4 PASSED AND ADOPTED by the City Council of the City of Newport 5 Beach, California, at a regular meeting thereof held this 12th day 6 of June, 1950 by the following vote, to -wit: 7 AYES: Councilmen Finch, Drake, Greeley, Blue, Isbell 8 NOES: Councilmen None 9 ABSENT: Councilmen None 10 APPROVED: /s/ L.
