HomeMy WebLinkAbout3808 - Sanitary Sewers in Balboa Boulevard1 2 • 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19', 20 21 22 23 24 25 26 27 28 29 30 31 32 C 0 P Y RESOLUTION OF INTENTION NO. 3808 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE CONSTRUCTION OF SANITARY SEWERS IN BALBOA BOULEVARD AND OTHER STREETS AND PUBLIC PROPERTY IN SAID CITY; DELCARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID WORK AND TO PAY THE COSTS AND EXPENSES, AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS TO SAID WORK. The City Council of the City of Newport Beach, pursuant to the provisions of the "Improvement Act of 1911 ", being Division 7 of the Streets and Highways Code of the State of California, DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of Newport Beach, California, to order the following work to be done, to -wit: DESCRIPTION OF WORK First: The construction of vitrified clay pipe sanitary sewer, vitrified clay pipe house connection sewers, manholes and work in connection therewith; in BALBOA BOULEVARD (between the Northeasterly prolongation of the Southeasterly line of Forty -fifth Street and the Northerly city limits of the City of Newport Beach, as shown on Sheet 2 of the plans hereinafter referred Ito. Second: The construction of vitrified clay pipe sanitary sewer Imanholes and appurtenant work in connection therewith, in the Southwesterly side of that certain COUNTY ROAD also known as Balboa Boulevard, and the Northerly extension thereof, between the Northerly city limits of the City of Newport Beach and the existing sewer trunk line of said City located in the Southerly side of the State Highway, as shown on Sheet 2 of said plans. Third: The construction of vitrified clay pipe sanitary sewers vitrified clay pipe house connection sewers, vitrified clay pipe 1 0 1 • 2 • 3 4 5 6 7 8 9 10 111 12 13 14 15 16 17 18 19 20 21'. 22 2311 24 25 26 27 • 28 • 29 30 31 32 C 0 P Y lamp- holes, manholes and appurtenant work in connection therewith; in CHANNEL PLACE between the Northeasterly line of Balboa Boulevard and a line drawn parallel with and distant 25 feet Southeasterly from and parallel with the Northeasterly prolongation of the Southeasterly line of Forty - fourth Street, as shown on Sheets 2 and 4 of said plans; and in FORTY -THIRD STREET between the Northeasterly line of River Avenue and a line drawn parallel with and distant 217 feet Southwesterly from the South- westerly line of Balboa Boulevard, as shown on Sheet 4 of said plans; and in FORTY - FOURTH STREET between Channel Place and a line drawn parallel with and distant 247 feet Southwesterly from the Southwesterly line of Balboa Boulevard, as shown on Sheet 4 of said plans. Fourth: The construction of vitrified clay pipe sanitary sewers, and appurtenant work in connection therewith; in certain PUBLIC PROPERTY owned by the City of Newport Beach and being along the Southwesterl side of Blocks 143 and 144 of the Canal Section of Newport Beach, as per map recorded in Miscellaneous Map Book 4, page 98, records of Orange County, California, crossing the alley in said Block 143, as shown on Sheets 2 and 4 of said plans; and in that certain COUNTY ROAD lying Northerly from and adjacent to the Northerly city limits of the City of Newport Beach, between the Southwesterly line of the County Road, known as Balboa Boulevard, and the Northerly city limits of said City, as shown on Sheet 3 of said plans. Fifth: The construction of vitrified clay pipe house !A :n C 0 P Y 1811 between Balboa Boulevard and a line drawn parallel with and distant 1911 6.5 feet Southwesterly from the Northwesterly prolongation of the 20 Northeasterly line of Lot 7, Block 45, River Section of Newport 21 i Beach, as per map recorded in Miscellaneous Map Book 4, Page 25, 22 records of said County, as shown on Sheet 3 of'said plans; and in 23 FORTY- SEVENTH STREET 24 and the Northeasterly prolongation thereof, over property owned 25 by the City of Newport Beach, between a line drawn parallel with 26 and distant 5 feet Southwesterly from and parallel with the 27 Northwesterly prolongation of the Northeasterly line of Lot 17, • 28 Block 46 of said River Section, and the Northeasterly end of said • 29 Forty - seventh Street, as shown on Sheet 3 of said plans. 30 Seventh: The construction in the Westerly side of that 31 certain County Road, also known as Balboa Boulevard, at a point 32 approximately 120 feet Northerly from the Northerly city limits 3 7! 1 connection sewer and appurtenant work in connection therewith; in • 2 certain • 3 PUBLIC PROPERTY 4 owned by the City of Newport Beach and being located along the 5 Easterly side of Lot 8, Block 145 of said Canal Section, and ex- 6 tending between the Northerly side of Channel Place and a point 7 distant 25 feet Northerly therefor, as shown on Sheet 2 of said 8 I plans. 9 Sixth: The construction of vitrified clay pipe sanitary I 10 sewers, vitrified clay pipe house connection sewers, vitrified 11 clay pipe lamp -holes and appurtenant work in connection therewith; 12 in 131 FORTY -FIFTH STREET 14'1 between Balboa line drawn distant Boulevard and a parallel with and 15 277 feet Southwesterly thereform, as shown on Sheet 3 of said 16 plans; and in 171 FORTY -SIXTH STREET 1811 between Balboa Boulevard and a line drawn parallel with and distant 1911 6.5 feet Southwesterly from the Northwesterly prolongation of the 20 Northeasterly line of Lot 7, Block 45, River Section of Newport 21 i Beach, as per map recorded in Miscellaneous Map Book 4, Page 25, 22 records of said County, as shown on Sheet 3 of'said plans; and in 23 FORTY- SEVENTH STREET 24 and the Northeasterly prolongation thereof, over property owned 25 by the City of Newport Beach, between a line drawn parallel with 26 and distant 5 feet Southwesterly from and parallel with the 27 Northwesterly prolongation of the Northeasterly line of Lot 17, • 28 Block 46 of said River Section, and the Northeasterly end of said • 29 Forty - seventh Street, as shown on Sheet 3 of said plans. 30 Seventh: The construction in the Westerly side of that 31 certain County Road, also known as Balboa Boulevard, at a point 32 approximately 120 feet Northerly from the Northerly city limits 3 7! C 0 P Y 4 1' 1 of the City of Newport Beach, of a reinforced cement concrete sump • 2 and pump chamber together with the installation of pumps, motors, • 3 electrical appliances, conduits, floats, cast iron pipes, valves, 4 fittings, equipment and appurtenances for the lifting or pumping of 5 raw sewage, as shown on Sheets 2 and 5 of said plans. 6 PLANS, PROFILES, DRAWINGS 7 AND SPECIFICATIONS 8 SECTION 2. All of the said work and improvement to be done 9 shall be constructed upon the grades, along the lines, between the 10 points, of the dimensions, at the places and in the manner shown on 11 the plans, profiles and drawings for the construction of said 12 improvements, in Balboa Boulevard and other streets and public i 13� property, being Plan No. 431, consisting of 5 sheets, on file in 14 the office of the City Engineer of said City, and except as other - 15 wise provided on said plans, in further accordance with the 16 specifications for the construction of said improvements, said 17 specifications being on file in the office of the City Clerk of 18 said City, and to which plans, profiles, drawings and specification; 191 heretofore approved by the City Council of said City reference is 201 hereby made for a further, full and more particular description of 21 said work and by reference thereto, the same are incorporated 22 ' herein and made a part hereof. 23 DESCRIPTION OF ASSESSMENT DISTRICT 24 25 SECTION 3. That the said contemplated work and improvement, 26 in the opinion of said City Council, is of more than local or 27 ordinary public benefit, and the said City Council hereby makes • 28 the expenses of the said work and improvement chargeable upon a • 29 district, which said district the said City Council hereby declares 30 to be the district benefited by said work and improvement and to 31 be assessed to pay the costs and expenses thereof, and which 32 district is described as follows: 4 1' i_J 1 All that certain territory of the City of Newport Beach, • 2 California, exclusive of streets and alleys, included within the • 3 exterior boundary line shown upon that certain Map or Plat No. 4 431 -A, heretofore approved by the City Council of said City on the 5 12th day of June, 1950, indicating by said boundary line the extent 6 of the territory included within the proposed assessment 7 district, and which map or plat is on file in the office of the 8 City Engineer of said City. Reference is hereby made to said map 9 or plat for a further, full and more particular description of the 10 said assessment district, and the said map or plat so on file 11 shall govern for all details as to the extent of said assessment 121 district. 1311 DESCRIPTION OF BONDS 141 SECTION 4. That serial bonds, bearing interest at the rate 1 151 of six per cent (6 %) per annum, shall be issued to represent each 16 assessment of Twenty -five Dollars ($25.00) or more remaining 17 unpaid for thirty (30) days after the date of recording the 1811 warrant. Said serial bonds shall extend over a period ending nine 19 (9) years from the second day of January next succeeding the next 20 October fifteenth following their date. Payments on the principal 21 of unpaid assessments and interest thereon shall be made by 22 property owners to the City Treasurer, and the same shall be 23 disbursed by said City Treasurer, all as provided in the 24 i "Improvement Act of 1911 ", hereinafter referred to. 2511 TIME AND PLACE OF HEARING 5 26 SECTION 5. NOTICE IS HEREBY GIVEN, that on the 24th day of 27 July, 1950, at the hour of seven - thirty (7:30) o'clock P.M., in 28 the chambers of the City Council in the City Hall of said City of 29 Newport Beach, any and all persons having any objections to the 30 proposed work or improvement, or to the extent of the assessment 31 district or to the proposed grades, may appear and show cause why 32 said work should not be done or carried out in accordance with 5 • • • 1 2 3 4 5 6 7 8 9 10 11� 12+ 13 14 15 16 171 18 19 20) 21 22 23 24 25 26 27 28 29 30 31 32 C 0 P Y this Resolution of Intention. Protests must be in writing and must be delivered to the City Clerk prior to the time set for the hearing. IMPROVEMENT ACT SECTION 6. That all of the work herein proposed shall be done and carried through in pursuance of an act of the legislature of the State of California, designated the "Improvement Act of 1911 ", being Division 7 of the Streets and Highways Code of the State of California. PUBLICATION OF RESOLUTION OF INTENTION SECTION 7. The "Newport- Balboa Press ", a weekly newspaper, printed, published and of general circulation in the City of Newport Beach, California, is hereby designated as the newspaper in which this Resolution of Intention shall be published by the City Clerk, in the manner and form provided by law and for making all other publications in the proceedings under this Resolution of Intention. The City Clerk is directed to mail notices of the adoption of this Resolution of Intention to all persons owning real property proposed to be assessed, whose names and addresses appear on the last equalized assessment roll for city taxes, all in the manner and form provided for under Sections 5070, 5194 and 5195 of said "Improvement Act of 1911" of said Streets and Highways Code. POSTING OF NOTICE OF IMPROVEMENT SECTION 8.
