Purse have of- <br />fared to sell the property hereinafter described to the City of <br />Newport Beach for the sum of 415,000.00; and <br />WHEREAS, said offer has been accepted and the said <br />Dudley R. Purse and Louise D. Purse and the City of Newport <br />have entered into an escrow for the transfer of the title to the <br />said property; and <br />WHEREAS, there has been presented to the City of New- <br />port Beach a Deed from Dudley R. Purse and Louise D. Purse to <br />the City of Newport Beach, the same being dated - February 29, 19 <br />and covering the following described property situated in the <br />City of Newport Beach, County of Orange, State of California: <br />16 and <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 and <br />29 <br />30 <br />31 <br />32 <br />Lots 5, 6, 9 and 10, Block "B -33" Corona del Fear, as <br />shown on a map thereof recorded in Book 3, pages 41 <br />and 42, Miscellaneous Maps, records of said Orange <br />County; <br />WHEREAS, said Deed contained the following conditions: <br />Provided however, that this conveyance is made and so- <br />9epted upon the following express conditions: That said <br />property shall be used for no other purpose than a pub- <br />lic park or beach and customary recreational purposes <br />Incident thereto. Provided, also, that a breach of the <br />foregoing condition shall cause said property to revert <br />to the grantor, his heirs or assigns who shall have the <br />right of immediate re -entry upon said property and such <br />breach or continuance thereof may be enjoined, abated or <br />remedied by the grantor, his heirs or assigns, Provided, <br />also, that a breach of the foregoing condition or any <br />re -entry by reason of such breach shall not defeat or <br />render invalid the lien of any deed of trust or mortgage <br />made in good faith and for value as to said property or <br />any portion thereof but said conditions shall be binding <br />upon and effective against any subsequent owner of said <br />property; <br />WHEREAS, it appears to be for the best interests of <br />the citizens of Newport Beach to accept and approve said Deed; <br />NOW, THERFFORE, BE IT RESOLVED that the said Deed <br />hereinabove referred to and covering the said hereinabove des- <br />1 <br />
