Purse have of- fared to sell the property hereinafter described to the City of Newport Beach for the sum of 415,000.00; and WHEREAS, said offer has been accepted and the said Dudley R. Purse and Louise D. Purse and the City of Newport have entered into an escrow for the transfer of the title to the said property; and WHEREAS, there has been presented to the City of New- port Beach a Deed from Dudley R. Purse and Louise D. Purse to the City of Newport Beach, the same being dated - February 29, 19 and covering the following described property situated in the City of Newport Beach, County of Orange, State of California: 16 and 17 18 19 20 21 22 23 24 25 26 27 28 and 29 30 31 32 Lots 5, 6, 9 and 10, Block "B -33" Corona del Fear, as shown on a map thereof recorded in Book 3, pages 41 and 42, Miscellaneous Maps, records of said Orange County; WHEREAS, said Deed contained the following conditions: Provided however, that this conveyance is made and so- 9epted upon the following express conditions: That said property shall be used for no other purpose than a pub- lic park or beach and customary recreational purposes Incident thereto. Provided, also, that a breach of the foregoing condition shall cause said property to revert to the grantor, his heirs or assigns who shall have the right of immediate re -entry upon said property and such breach or continuance thereof may be enjoined, abated or remedied by the grantor, his heirs or assigns, Provided, also, that a breach of the foregoing condition or any re -entry by reason of such breach shall not defeat or render invalid the lien of any deed of trust or mortgage made in good faith and for value as to said property or any portion thereof but said conditions shall be binding upon and effective against any subsequent owner of said property; WHEREAS, it appears to be for the best interests of the citizens of Newport Beach to accept and approve said Deed; NOW, THERFFORE, BE IT RESOLVED that the said Deed hereinabove referred to and covering the said hereinabove des- 1 I 1 II cribed real property and containing the above set out conditions, 2 is accepted and approved by the City of Newport Beach and is 3 hereby ordered recorded. 4 The above and foregoing'Resolution was duly passed 5 I and adopted at a regular meeting of the City Council of the City 6 of Newport Beach, held on the �214'4 day of 1952. 7 by the following vote, to wit: 8 AYES, COUNCILMEN: 10 11 NoEB, COUNCILMEN:.
