HomeMy WebLinkAbout3965 - Construction of Sanitary Sewers1 • 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 M5 RESOLUTION NO. 3965 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, ADOPTED PURSUANT TO THE PROVISIONS OF SECTION 2808 OF "SPECIAL ASSESSMENT INVESTIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931 "2 DIVISION 4 OF STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA. 6?HEREAS, the City Council of the City of Newport Beach, California, has received a communiation from the Health Officer of Orange County (who also acts as Health Officer in the City of Newport Beach under an agreement with said Count), and which communication is in words and figures as follows: it April 17,1952 To the Honorable City Council Newport Beach, California Geptlemen: As Health Officer of the City of Newport Beach and of the County of Orange, I hereby recommend that proceedings be instituted at once for the construction of sanitary sewers in that portion of Newport Beach bounded on the northeast by Ocean Blvd., on the southeast by Poppy Ave., on the southwest by the Pacific Ocean and on the northwest by Goldanrod Ave. as outlined in plans on file in the office of the City Engineer. This recommendation is made as a measure necessary for the protection of public health and is also made pursuant to Section 2808 of the Streets and Highways Code of the State of California. The area bounded by the above description is entirely bluff and beach area. At the present time the area.is only sparsely inhabited but the present trend is for increased construction activity. The bluff lots are relatively small in size and steep in grade. This combined with the fact that the soil conditions are not ideal for individual sewage dis- posal systems, warrants the above recommendation. This will also furnish sanitary sewers for the public rest rooms and concessions now located on the Corona Del Mar beach. Yours very truly, /s/ EM4. AND WHEREAS, the City Council has duly considered the said communication, and has received information from the City Engineer with reference to the proposed sewer improvements, referred to in said communication: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NWPORT BEACH, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, FIND, DETERMINE AND ORDER AS FOLLMIS: SECTION 1. That the improvements referred to in said communication above quoted are the construction of sanitary sewer mains, pumping station and appurtenant work in connection there- with to serve that portion of the city lying generall Southwester ly of Ocean Boulevard, between Goldenrod Avenue and Poppy Avenue, all as particularly shown and delineated on plans and profiles, No. 436 consisting of 5 sheets, heretofore approved by the City Council and now on file in the office of the City Engineer of said City. SECTION 2. That said City Council does hereby find and determine that the construction of said sanitary sewer mains and appurtenant work in connection therewith, and each of them, is necessary as a health measure and such necessity for such construction is found to exist. SECTION 3. That the City Clerk is hereby authorized and instructed to spread the contents of said original communication upon the minutes of this meeting of the said City Council, at which this resolution is adopted. SECTION 4. That this resolution is adopted under and pur- suant to the provisions of Section 2808 of the "Special Assess- ment Investigation, Limitation and Majority Protest Act of 1931 ". Division 4 of the Streets and Highways Code of the State of California, and the City Council in adopting the same intends to meet each and every concfftion and to make each and every finding necessary on its part in order to permit the proceedings for said 1 2 3 • 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 • 29 30 31 32 sewer improvements to go forward to completion without further reference to or application of the provisions of said Division 4 of said Streets and Highways Code. PASSED AND ADOPTED by the City Council of the City of Newport Beach, California, at a regular meeting thereof. held this 28th day of April, 1952 by the following vote, to -wit: AYES: Councilmen Miller, Horvath, Finch, Isbell, Smith NOES: Councilmen None ABSENT: Councilmen None APPROVED: /s/ A.
