HomeMy WebLinkAbout4094 - Special Annexation Election - 7-21-19531 • 2 3 • 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 • 28 • 29 30 31 32 RESOLUTION NO. 4094 WHEREAS, by Resolution No. 4088, the City Council of the City of Newport Beach declared its intention to call a special election to be held on the 21st day of July, 1953, in certain inhabited territory contiguous to said city proposed to be annexed to said city, for the purpose of submitting to the qualified electors residing in said territory the question whe or not said territory shall be annexed to said city; and WHEREAS, a copy of said resolution was published as re by law; and WHEREAS, at a time not later than the hour set by said resolution for hearing objections to the proposed election no written or oral protests were made by the owners of a majority of separate parcels of property within the territory proposed to be annexed; and WHEREAS, all proceedings have been had in accordance with said resolution and the Annexation Act of 1913, reference there- to being made for further particulars; NOW, THEREFORE, BE IT RESOLVED as follows: SECTION ,. A special election hereby is called to be held on the 21st day of July, 1953, in the territory hereinafter described and proposed to be annexed to the City of Newport Beach, for the purpose of submitting to the qualified electors residing in said territory the question whether or not such teri shall be annexed to, incorporated in, and made a part of said Cl of Newport Beach, and whether or not the property in said territory shall, after such annexation, be subject to taxation, equally with the property within the City of Newport Beach, to pay the entire bonded indebtedness of the City of Newport Beach outstanding or authorized at the date of the filing of the petition for annexation for the acquisition, construction or completion of municipal improvements. Said territory is described as follows: CLIFF HAVEN AREA EXHIBIT 'At . Beginning at the intersection of the Southwesterly prolongation of the center line of Irvine Avenue, as shown upon a Map of First Addition to Newport Heights, Miscellaneous Maps, Book 4, Page 94, • Records of Orange County, California, and the Northwesterly pro- longation of the Northeasterly line of Tract No. 1210, recorded in Miscellaneous Maps, Book 40, Pages 45 - 46, Records of said Orange County; thence, Easterly along said Northwesterly prolonga- tion and along the Northerly line of said Tract No. 1210 and its Easterly prolongation, said line also being the boundary line of the City of Newport Beach, to its intersection with the Westerly line of Lot 1, as shown upon a map of Tract No. 1125, recorded in Miscellaneous Maps, Book 39, Pages 7 and 6, Records of said Orange County; thence, Northerly along said Westerly line and along said City Boundary line to the most Northwesterly corner of said Lot 1; thence, Westerly on a straight line to the most Northerly corner of Lot 10, Block D, Tract 1219, as shown upon a map recorded in Miscellaneous Maps, Book 36, Pages 26 and 27, Records of said Orange County; thence, Northerly along the Westerly line of 17th Street, as said street is shown upon a map of said Tract No. 1219, to the most Easterly corner of Lot 16, as shown upon a map of Tract No. 1216, recorded in Miscellaneous Maps, Book 37, Pages 47 to 49 inclusive, Records of said Orange County; thence, Northerly along the Westerly line of 16th Street, as said street is shown upon a map of said Tract No. 1216 to the most Northerly corner of Lot 146, as shown upon a map of said Tract 1216, said point also being the most Easterly corner of Lot 4, of said Tract No. 1125; and also being an angle point in the City Boundary Line of the City of Newport Beach; thence, South 150 57' 0 If West, along the Easterly line of said Lot 4, a distance of 516.26 feet, to a point; thence, Westerly along the Southerly line of said Lot 4 and along said City Boundary line, the following courses and distances; on a curve concave to the Southeast having a radial bearing of South 00 491 2,611 East, and having a radius of 3001, a distance of 142.26 feet; thence, tangent to the last- mentioned curve, South 620 001 2511 West, a distance of 71.07 feet to the beginning of a curve con- cave to the North, having a radius of 193.50 feet, a distance of 196.64 feet; thence, on a curve tangent to the last- mentioned curve concave to the South having a radius of 300 feet, a distance of 165.66 feet; thence, tangent to last- mentioned curve South 640 43' 55" West, a distance of 196.00 feet to the beginning of a curve concave to the Southeast having a radius of 300 feet, a distance of 235 62 feet; thence, tangent to last- mentioned curve South 390 43' 55" West, to an intersection with the Northeasterly line of 15th Street, said line also being the Southwesterly like of Lot 4, as shown upon a map of said Tract No. 1125; thence, Northwesterly along said Northeasterly line of 15th Street, a distance of 173.00 feet to a point; thence, Southwesterly on a straight line to an angle point in the City Boundary Lien of the City of Newport Beach, said point also being the intersection of the Southwesterly boundary of that certain parcel of land conveyed by the Irvine Company to the County of Orange for Highway purposes and described in Deed Book 1521, Page 257, Official Records of • Orange County, and a line 20.00 feet Northwesterly of and parallel to the Northwesterly boundary of said Tract No. 1216; thence, • Southwesterly along said parallel line, and along a line 20 feet Northerly of and parallel to the Northerly boundary of Tract No. 1220, as shown upon a map recorded in Miscellaneous Maps, Book 36, Pages 49 and 50, Records of said Orange County, and along said City Boundary Line to an intersection with the Northeasterly pro- longation of the Southeasterly line of College Road, as shown upon a map of said Tract 1220; thence, Northerly along said Northerly prolongation and along said City Boundary Line a distance of 4.40 feet to the beginning of a curve concave to the Southeast, having • radius.of 320 feet; thence, Northeasterly along aid curve through • central angle of 210 121 10", a distance of 118.42 feet; thence, Northeasterly tangent to the last- mentioned curve and at right angles with said Southwesterly line of said parcel described in Book 1F21.. SECTION 2. TIME OF OPENING AND CLOSING OF POLLS. The polls at said election shall be opened at 7 o'clock a.m. of the day herein fixed for the holding of said election and shall be kept open until 7 o'clock p.m. of the same day, when the polls shall be closed. SECTION 3. BALLOTS. Upon the ballots to be used at said election there shall be printed the words: ' SHALL CLIFF HAVEN ANNEXATION BE ANNEXED, TO, INCORPORATE IN AND MADE A PART OF THE CITY OF NEWPORT BEACH AND THE PROP- ERTY IN SUCH TERRITORY BE, AFTER SUCH ANNEXATION, SUBJECT TO TAXATION EQUALLY WITH THE PROPERTY WITHIN THE CITY OF NEWPORT BEACH, TO PAY THE ENTIRE BONDED INDEBTEDNESS OF THE CITY OF NEWPORT BEACH OUTSTANDING OR AUTHORIZED AT THE DATE OF THE FILING OF THE PETITION FOR ANNEXATION FOR THE ACQUISITION, CONSTRUCTION OR COMPLETION OF MUNICIPAL IMPROVEMENTS. Opposite these words there shall be printed the words "Yes" and "No ", and to the right of each of these last two words there shall be a voting square. If an elector shall stamp a cross (4) in the voting square after the printed word "Yes" the vote of such elector shall be counted in favor of the annexation of said territory to the City of Newport Beach; and if an electo shall stamp a cross (1) in the voting square after the printed word "No" the vote of such elector shall be counted against such annexation. In all particulars not herein recited said election shall be held in conformity, as near as may be, with the laws of the State of California concerning general elections and with said Annexation Act of 1913. SECTION 4. (a) For the purpose of said election there hereby is established in the territory described herein one (1) voting precinct, which shall include all of said territory. The following is the polling place of said election precinct and the following named persons hereby are named officers of election an C 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 • 28 • 29 30 31 32 shall constitute the board of election for such election precinc : Polling Place: Garage at 23601 Signal Road, Orange County Inspector: Mrs. Betty Sharp, 2275 St. James Road Judges: Mrs. Beatrice Altman, 23586 Signal Road Mrs. Dale Lusk, 23582 Signal Road (b) For their services in connection with said election, said inspector shall receive $10.00 and said judges $10.00 each; and the person in possession of the polling place named herein shall receive for the use of such premises in connection with said election the sum of $10.00. SECTION 5. The City Clerk shall publish a notice of said special election as required by said Annexation Act of 1913, at least once a week for the four (4) weeks prior to the date of th election on July 21, 1953, in the Costa Mesa Globe- Herald, a new!- paper of general circulation printed and published outside of th City of Newport Beach but in the County of Orange, California. I hereby certify that the foregoing Resolution No. 4094 was adopted by the City Council of the City of Newport Beach at its meeting held on the 22nd day of June, 1953, by the following vote: ATTEST: /s/ C.
