3 WKETUS9 there has been filed with the City of Newport
4 Hesah, a request by 'William W. beaquist, and others, to have the
5 City consent to the annexation of certain adjacent property con -
6 slating of two square bloeke in the County of Orange, subetan-
7 tially described as bounded on the Last by Irvine Avenue, on the
8 North by 16th Street, on the hest by Banta Ana Avenue and on the
9 South by 15th Street; and
10 HERLAS, all steps were taken by the interested partie�
11 I towards the annexation of said parcel up to the point were the
12 City was enjoined from proceeding further by virtue of a Writ of
13 Mandate secured by the County of Orange; and
14 WHIRFAS, the Board of supervisors of the County of
15 orange did establish the boundaries of the proposed City of Cosh
16 Mesa as including the Westerly half of said Ueaquist Parcel; and
17 WHEREAS, the City of Costa Mesa became incorporated on
18 June 29, 1953, the boundaries thereof including the said 'gester34
19 half of the Seaquist parcel; and
20 WHYRrAS, it appears to the City Council of the City of
21 Newport Beach that the boundaries of the City of Newport reach
22 and the boundaries cif the City of Costa Mesa are indefinite and
23 uncertain in that it cannot be determined, without a Judgment of
24 a Court of competent jurisdiction, whether or not the said "+est-
25 erly half of said Seaquist Parcel should be included within the
26
City of Newport }leach or the City of Costa Mesa; and

29 alone of seotion 51000, and following, of the Government Code of
30 the State of California to establish, define and determine the
31 boundaries of the two cities;

brought in the name of the City of He�:aort peach, under the pro-
visions of sections 51000 and following, of the Government 0odt
to have tho boundry line between the City of Newport Beach and
the City of Cotta t?eta determined, defined and established inso-
far as the same is indefinite and uncertain on the question of
whether or not the Vesterly half of the said "euCQuist parcel
should be included in the City of Costa Mesa or the Gity of New-
.port Beach.
The above and foregoing Aesolution was duly and regul-
arly passed and adopted by the City Council of the City of
Peach, at a regular meeting thereof, held on the 14th day of
September, 1953, by the following vote, to wit:
