NOTICE OF ELECTION 1 WHEREAS, by Resolution No.81, the City Council of the 2 city of Uewport Beach decW*d its intention to call a special 3 — election to be held on the. a2� day of 19.5 L, in 4 certain inhabited territory contiguous to said city proposed to be 5 annexed to said city, for the purpose of submitting to the quali- 6 fled electors residing in said territory the question whether or 7 riot said territory shall be annexed to said city; and 8 WIMRSAS, a copy of said resolution was published as require 9 by law; and 10 - E41WHAEAS, at a time not later than the hour set by said 11 resolution for hearing objections to the proposed election no 12 written or oral protests were made by the owners of a majority of 13 separate parcels of property within the territory proposed to be 14 annexed; and 15 VIIiEREAS, all proceedings have been had in accordance with 16 said resolution and the Annexation Pict of 1913, reference thereto 17 being made for further particulars; 18 NOW, 'MERE70RE0 BE IT RE30LVLD as follows. 19 SECTION 1. A special election hereby is called to be held 20 on the a 4T-` day of , 19" in the territory herein - 21 after described and proposed to bo annexed to the city of Newport 22 Beach, for the purpose of submitting to the qualified electors 23 residing in said territory the question whether or not -such terri- 24 tory shall be annexed to, incorporated in, and made a part of said 25 City of Newport Beach, and whether or not the property in said to 28 ritory shall, after such annexation, be subject to taxation, equally 27 with the property within the City of Newport ]teach, to pay the 28 entire bonded indebtedness or the City of Newport Beach outstand- 29 ing or authorized at the date of tho filing of the petitu.% for 30 - =gam annexation for the acquisition, construction or completion of 31 municipal improvements. 32 Laid territory is described as follows; -1 STRICKER ANNEXATION Beginning at the intersection of the easterly line of the 100 foot right Of way granted to the Santa Ana Railroad, a corporation, by deed dated Oct - ber 10, 1889 and recorded in Book 10, Page 117 of deeds, Records of Orange Ank County, California, and the westerly prolongation of the northerly line of Lot 5 as shown upon a map of Tract No. 1136, recorded in Miscellaneous Maps Book 37, Pages 18 and 19, Records of Orange County; thence northerly along said easterly right of way line to its intersection with the southwesterly prolongation of the northwesterly line of a parcel of land deeded to the State of California for public highway by deed recorded in Book 809, Page 86, off- icial records of said Orange County; said point being the true point of begin- ning; thence northeasterly along said northwesterly line to the most northerly corner of said parcel and along said City boundary line, said corner being in the northwesterly line of an eighty foot strip of land described in deed from John J. Thornton et al, to the County of Orange, recorded in Book 72, Page 131 of official records of said Orange County; thence northeasterly along said last mentioned northwesterly line on a curve concpve to the northwest and hav- ing a radius of 500 feet to its intersection with the northweaterly prolong- ation of the northeasterly line of Beacon Street as shown on said map of Tract No. 1136; thence southeasterly along said prolongation and along said city boundary line to its point of intersection with the center line of Westminster Avenue as shown upon a map of Tract No. 464 recorded in Miscellaneous Maps Book 32, Page 1, said point also being in the boundary line of the City of Newport Beach; thence northeasterly along said center line of Westminster Ave- nue and along said city boundary line to an angle point in the city boundary line of the City of Newport Beach, which point bears south 550 37' west 345.66 feet and north 600 47' west 33.50 feet from the most northerly corner of said Tract No. 464; thence south 600 47' east a distance of 511.87 feet to an inter- section with the center line of Old County Road, 50.00 feet in width, as shown upon a map of Tract No. 27, Miscellaneous Maps Book 9, Page 26, Records of said Orange County; thence north 130 57' west a distance of 521.66 feet al -~'� said center line of Old County Road and along said city boundary line to an intersection with the center line of Westminster Avenue as shown upon a map of First Addition to Newport Heights recorded in Miscellaneous Maps Book 4, Page 94, Records of said Orange County; thence north 390 50' east along said center line of Westminster Avenue and along said city boundary line a distance of 707.03 feet to an intersection with the center line of 15th Street as shown on aforesaid map of First Addition to Newport Heights; thence north 490 30' west along the center line of said 15th Street to its intersection with the easterly line of the 100 foot right of way granted to the aforementioned Santa Ana Railroad said point also being an angle point in the city boundary of the City of Newport Beach; thence southerly along said easterly line to the true point of beginning. -2- 0 _• Said territory is designated and identified for said 2 election purposes and for use upon the ballots at said election 3 as "Stricker Annexation." 4 SECTION 2, TIMB Or OPENING AND CLOSING. OF POLLS. The poll 5 I at said election shall be opened at 7 o'clock a.m. of the day here 6 II in fixed for the holding of said election and shall be kept open 7 until 7 o'clock p.m, of the same day, when the polls shall be clos 8 SECTION 3, BALLOTS. Upon the ballots to be used at said 9 election there shall be printed the words: 10 SHALL STRICKER ANNVATION BE ANNEXED T09 INCORPORATED IN 11 AND MADE A PART OF THE CITY OF NEWPORT BEACH AND THE PROPERTY IN SUCH TERRITORY BE, AFTER SUCH ANNEXATION, SUBJECT TO TAXATION 12 EQUALLY WITH THE PROPERTY WITHIN 'THS CITY OF NLWYORT BEACH, TO PAY This ENTIRE BONDED INDEBTEDNESS OF THE CITY OF NEWFORT BEACH 13 OUTSTANDING OR AUTHORIZED AT THE DATE OF TFiK FILING OF THE PETITIC FOR ANNEXATION FOR THE ACQUISITION, CU14STRUCTIUK OR COMPLETION OF 14 MUNICIPAL IMPROVEMENTS? 15 Opposite these words there shall be printed the words "Yes" 16 and "No ", and to the right of each of these.last two words there 17 shall be a.voting square# if an elector shall stamp a cross ( +) is In the voting square after the printed work "Yes" the vote of suet 19 elector shall be counted in favor of the annexation of said terri- 20 tory to the City of Newport Beach; and if an elector shall stamp 21 a cross (+) in the voting square after the printed word "No" the 22 vote of such elector shall be counted against such annexation. 23 In all particulars not herein recited said election shall 24 be held in conformityt as near as may be, with the laws of the 25 State of California concerning general elections and with said 26 Annexation Act of 1913. 27_ SECTION 4. (a) For the purpose of said election there 28 hereby is established in the territory described herein one (1) 29 voting precinct, which shall include all of said territory. The City Clerk shall publish E. notice of said special election as required by said ;innexatlon :pct of 1913, at least once a week for the four- (4) weeks prior to the date of the election on February 24th, 19J4, in the Costa Mesa Glob Herald, a newspaper of general circulation printed and published outside of the City of Newport Beach but in the County of Orange, California.
