HomeMy WebLinkAbout4209 - Seaquist Annexation Special Election1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 N0. 4 % WAS, by Resolution Noe 4204, the City Council of the City of Newport Beach declared its intention to call a special elect to be held on the thirty -first day of Marche 19.T4t in certain Inhabited territory contiguous to said city proposed to be anne to said citys for the purpose of submitting to the qualified electors residing in said territory the question whether or not said territory shall be annexed to said city; and WHEREAS, a copy of said resolution was published as required by law; and WHEREAS, at a time not later than the hour set by said reso- lution for hearing objections to the proposed election no written or oral protests were made by the owners of a majority of separate parcels of property within the territory proposed to be annexed; and WHEREAS, all proceedings have been had in accordance with said resolution and the Annexation Act of 1913, reference thereto' being made for further particulars; NOW, THEREFORE, BE IT RESOLVED as followss SECTION 1. A special election hereby is called to be held on the thirty -first day of Marche 1954, in the territory herein- after described and proposed to be annexed to the City of Newport Beach, for the purpose of submitting to the qualified electors residing in said territory the question -whether or not such terri. tory shall,be.'annexed toe incorporated in, and made a part of sai4 City of Newport Beach, and whether or not the property in said territory shale., after such annexation, be subject to taxation, equally with the property within the City of Newport Beach, to pa; the entire bonded indebtedness of the City of Newport Beach"out- standing or authorized at the date of the filing of the peitition for annexation for the.acquisitions construction or completion of municipal improvements. Said territory is described as follows: 1 -1- i 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 M 27 M 29 30 31 32 All that certain land situated in the Costa Mesa Sanitary District Newport Heights Irrigation Dis- trict County of orange, State of California, des - cribes as followss Beginning at the intersection of the Southwesterly prolongation of the Southeasterly line of Irvine Avenue, 60 feet wide, and the Southeasterly prolongation of the center line of Fifteenth Street, as shown upon a map of Newport Heights, recorded in Book 49 page 83, of Miscel- laneous Maps, records of Orange County, California; thence Northeasterly along the said Southwesterly pro- longation of the Southeasterly line of said Irvine Avenue and along said Southeasterly line of said Irvine Avenue and its Northeasterly prolongation to its inter- section with the Southeasterly prolongation of the Northeasterly line of Sixteenth 6treet as shown upon said map of Newport Heights; thence Northwesterly along said prolongation of said Northeasterly line of Sixteenth Street and along the Northeasterly line of Sixteenth Street to its intersection with a line lying 30 feet Northwesterly of and parallel to the center line of Santa Ana Avenue as shown upon said map of Newport Heights thence Southwesterly along skid parallel line to its intersection with the center line of Fifteenth Street; thence Southeasterly along said center line of Fifteenth Street to the point of beginning. Excepting therefrom the following, to -wits Beginning at the most Southerly corner of Tract 1583; thence Northeasterly along the Southeasterly line of said Tract to the most easterly corner of said Tract; thence Northwesterly along the Northeast- erly line of said Tract 1583 to the most Northerly corner thence Southwesterly along the Northwesterly line of said Tract and its Southwesterly prolongation to its intersection with the center line of Fifteenth Street as shown upon said Map of Newport Heights; thence Southeasterly along said center line to its intersection with the Southwesterly prolongation of the Southeasterly line of said Tract; thence North- easterly along said Southwesterly prolongation to the point of beginning. Said territory is designated and identified for said election purposes and for use upon the ballots at said election as "Seaquist Annexation ". SECTION 2, TIME OF OPENING AND CLOSING OF POLLS. The polls at said election shall be opened at 7 o'clock a.m. of the day herein fixed for the holding of said election and shall be kept Open until 7 o'clock p.m. of the same day, when the polls shall be closed. SECTION 3, BALLOTS. Opposite these words there shall be printed the words "Yes" and "Not', and to the right of each of these last two words there shall be a voting square. If an elector shall stamp a cross ( +) In the voting square after the printed word "Yes" the vote of such elector shall be counted in favor of the annexation of said territory to the City of Newport Beach; and if an elector shall stamp a cross (f) in the voting square after the printed word "Mc the vote of such elector shall be counted against such annexatiox In all particulars not herein recited said election shall be held in conformity, as near as may be, with the laws of the of California concerning general elections and with said Anneua- tion Act of 1913. SECTION 4. (a) For the purpose of said election there is established in the territory described herein one (1) voting precinct, which shall include all of said territory.
