1
WHEREAS, the City Council of the City of Newport Beach

has heretofore filed with the Boundary Commission of Orange County,
3
State of California, a proposal for determining the definiteness and
4
certainty of the boundaries of the Upper Bay area annex on Feb. 17,
5
1955; and
6
WHEREAS, the City Council of the City of Newport Beach
7
has considered that it would be for the best interests of the owners

of said real property and for the citizens of Newport Beach that an
9
amendment to said proposal be made to the Boundary Commission of
10
Orange County; and
11
WHEREAS, the real property covered by this amended proposal
12
is in unincorporated territory and situated in the County of Orange,
13
State of California; and
14
WHEREAS, the said property is uninhabited and contiguous to
15
the City of Newport Beach within the meaning of the Annexation of
16
Uninhabited Territory Act of 1939; and
17
NOWO THEREFORE,BE IT RESOLVED, that the City Council of

the City of Newport Beach submit an.amended proposal and map to the
19
County Boundary Commission of Orange County, State of California, in
20
accordance with the Annexation of Uninhabited Territory Act of
21.
1939; that the amended proposal shall request said Boundary Commissio
22
to determine the definiteness.and certainty of the boundaries of
23
the real property referred to as the Upper Bay Annex and which is

described in Exhibit "B" attached hereto and made a part hereof
25
as though set out in full herein.

BE IT FURTHER RESOLVED, that the Mayor and City Clerk
27
of the City of Newport Beach, be and they are hereby authorized to

execute said amended proposal on behalf of the City of Newport
Beach to be verified by the said City Clerk and to file same with
30
said Boundary Commission of said Orange County.

The above and foregoing Resolution was duly passed
32
and adopted at a meeting of the City Council of the City of Newport

1 held on the 28th day of February, 1955, by the following vote,
