RESOLUTION NO. 4438
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH CALIFORNIA, ORDERING THE WORK
DESCRIBED IN RESOLUTION OF INTENTION NO. 4421,
ADOPTED ON THE 27TH DAY OF DECEMBER, 1955, IN
THE MATTER OF THE CONSTRUCTION OF CERTAIN
PAVING, SIDEWALKS CURBS GUTTERS, SANITARY
SEWERS, DRAINAGE kRUCTUAES, WATER SERVICE
CONNECTIONS AND AN ORNAMENTAL LIGHTING SYSTEM
IN 31ST STREET AND OTHER STREETS AND RIGHTS
OF WAY IN THE CITY OF NEWPORT BEACH, CALIFORNIA.
THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH) CALIFORNIA, pur-
suant to the provisions of the "Improvement Act of 191111,
being Parts 1, 2 and 3 Division % of the Streets and
Highways Code of the State of California, DOES HEREBY
RESOLVE AS FOLLOWS:
That the public interest and convenience require the work
hereinafter mentioned to be done and, therefore, the said City
Council hereby orders the following work to be done and improve-
ments to be made in said City, to wit:
The construction of certain paving, sidewalks, curbs,
gutters, sanitary sewers, drainage structures, water service
connections and an ornamental Lighting system in 31st Street
and other streets and rights of way, and appurtenant work in
connection therewith, all as more particularly described in
Resolution of Intention No. 4421, passed and adopted by the
City Council of said City on the 2 7th day of December, 1955,
and on file in the Office of the City Clerk of said City.
For all further particulars reference is hereby made to
said Resolution of Intention No. 4421 and to the plans and
profiles on file in the Office of the City Engineer of said
City, and to the specifications for said work heretofore adopt-
ed by said City Council and on file in the Office of the City
Clerk and in the Office of the City Engineer of said City, and
all of said plans, profiles and specifications heretofore
approved by the City Council of said City are incorporated

herein and made a part hereof and reference is hereby made thereto
- for a more particular description of said work.
Said City Council has determined and declared that the con -
templated work and improvement heretofore mentioned was in the
opinion of said City Council of more than local or ordinary public
benefit and said City Council. has made the expenses of said work
chargeable upon a district. For the particular description of
said district, reference is hereby made to said Resolution of
Intention No. 4421.
Said City Council has determined and declared that serial
bonds bearing interest at the rate of six per cent (6%) per annum
and extending over a period ending nine (9) years from the second
day of January next succeeding the next October fifteenth follow-
ing their date, will be issued hereunder in the manner provided
by the "Improvement Act of 191111, being Fart 5, Division 7 of the
Streets and Highways Code of the State of California, to repres-
ent each assessment of Twenty -five Dollars'($25.00), or more,
remaining unpaid for thirty days after the date of recording the
warrant.
All of the work herein ordered shall be done and carried
through pursuant to an Act of the Legislature of the State of
California, designated as the "Improvement Act of 1911", being
Parts 1, 2 and 3 of Division 7 of the Streets and Highways Code
of said State.
The City Clerk of said City is hereby directed to post con-
spicuously for five days on or near the Council Chamber door, in
the manner and form required by said Code, a notice inviting
sealed proposals or bids for doing the work herein ordered, and
the City Clerk is hereby directed to publish twice in the
"NEWPOF.T HARBOR NEWS PRESS ", a newspaper of general circulation

published and circulated in said City and hereby designated by
said City
Council
for
that
purpose, a
notice
inviting such
proposals
or bids
for
doing
the said
work and
referring to the
specifications on file.
APPROVED AND ADOPTED by the City Council, signed by the
Mayor, and attested by the City Clerk this 13th day of February,
