UNDER TM PROVISIONS OF THE ANNEXATION ACT OF
1913.
SEAS, William D. Clark and others have petitioned
the City of Nmoport Beach for its consent to the annexation of
certain property referred to as "Tustin Avenue and 22nd Street
Annex," which is hereinafter describe&, in the County of Orange,
State of California, contiguous to the pre3ent city boundsrlea
of the City of Newport Beach, under the Annexation Act of 1913;
and
WREMS, mid petition mss referred to the Planning
Commission of the City of Newport .Beach for investigation,
report and Pecommen4ationj and
N
NiiMEMS; the Planning Commission of the City of Newport
Beach rendered its report and recommendation to the City
Council on the 16th day of February, 195 -, giving its approval
of the proposed annexation of said property to the City of Now
}leach; and
WiYMAS, the County Boundary Commission of orange
has heretofore approved the proposed bouadarioea of said
"Tustin Avenue and 22nd Street Annex" as to definiteness and
certainty;
NON, THEREFORE, BE IT RESOLVED that the City Connell
of the City of Newport Beach does hereby consent to the commwme-
ment of annexation proceedings with said inhabited territory in
accordance with the Annexation Act of 1913, provided that the
petition for annexation ocatains a request that the question to
be submitted to the electors residing in the territory proposed

to be annexed shall be whether the territory shall be annexed
and the property in the territory subjected to taxation after
anneAlon equally with property within the City of Newport Beach
to pay the entire bonded indebtedneas of the City of Newport
Beach outstanding or authorized at the date of the first publi-
cation of the Notice of Election for annexation, for the
acquisition, construction or completion of municipal improvement
and hereby further consents that the proponents of said atusexati
shall proceed with the steps necessary under said Annexation
Aet of 1913; and
BE IT PMTr iER RESOLVI-Xv that said inhabited and unl n-
aarporated territory be and it is hereby designated as the
"2Listin Avenue and 22nd Street Annex" whioh is described as
follows
"Beginning at an angle point In Boundary Line of the
City of Newport Beach, said angle point Mein„ the point of inter -
mwtion of the northwesterly line of that County Road known an
Irvine Avenue extension, 90 feet In width, and the southwesterly
line of Lot 298 as shtia:an upon a map of Dlevport Heights recorded
in Kiscellaneouo Map Book 41 Page 83, Records of Orange County,
California, said single point also being in the northeasterly litre
of 22nd Street as shown upon said :^u4, or Newport Heibhta; thence
northwesterly along said northeasterly lire of 22nd Street to a
point of intersection with the southeasterly line of Tustin Amt
as shoran upon said map of Newport nelghts; thence northeasterly
along said southeasterly line of Tustin Avenue to an angle point
In the boundary line of the City of Newport Beach; said angle
point being the most northerly oorrer of Lot 104 as shown upon a
map of Tract No. 300, recorded in Mscellaneoua Map Book 14,
Pages 11 and 12, Records of said Orange County; thence south-
easterly along said City Boundary line to a point of intersection
with the westerly line of the afdrementioned Irvine Avenue

westerly line and along, said City ; Boundary line to a point of
intersection with the southeasterly line of said Lot 104; thence
southwesterly along said City Boundary line to an angle points
said angle point being distant 52 feet northeasterly from the
most westerly corner of Lot 318 as shown upon the aforementioned
map or Newport Heighta; thence southeasterly along; said City
Boundary line to a point of intersection with the aforementioned
westerly line of Irvine Avenue extension; thence southerly and
southwesterly along the westerly and northwesterly line of said
Irvine Avenue extension and along said City Boundary line to
the point or beginning."
The above and foregoing Resolution No. &Y10 was
duly and regularly passed and adopted by the City Council
of the City of Newport &— ,axah, at a regular meeting thereof,
held on the 27th day Of February, 1q+36, by the following roll
call vote, to wit: I
