HomeMy WebLinkAbout4726 - Vacation & Abandonments of Streets & Alleysq-0 RESOLUTION NO. 4-);L 6 A RESOLUTION OF INTENTION OF THE COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING ITS INTENTION TO ORDER THE CLOSING UP,:VACATION AND ABANDONMENT OF PORTIONS OF CERTAIN STREETS KNOWN AS SHORE AVENUE, WAVE STREET, HELIOTROPE AVENUE, IRIS AVENUE, JASMINE AVENUE, LARKSPUR AVENUE AND NARCISSUS AVENUE AND CERTAIN ALLEYS, ALL IN THE CITY OF NEWPORT BEACH, COUNTY OF ORANGE, STATE OF CALIFORNIA. The City Council of the City of Newport Beach, pursuant to the provisions of the "Street Vacation Act of 1941 ", and all amend- ments thereto, being Sections 8300 to 8331, inclusive of the Streets and Highways Code of the State of California, does hereby re solve and declare as follows: SECTION 1: That the public interest and convenience require. the closing up and abandonment of portions of certain streets known as Shore Avenue, Wave Street, Heliotrope Avenue, Iris Avenue, Jasmine Avenue, Larkspur Avenue, and Narcissus Avenue, and certain alleys in the City 'of Newport Beach, and it is the intention of the City Council of the City of Newport Beach to order the portions of said streets and alleys, hereinafter described, in the City of Newport Beach, County of Orange, State of California, to be vacated, closed up, and aban- doned. All those portions of said streets and alleys to be vacated, closed up, and abandoned, are more clearly shown on a certain map approved and adopted by the City Council of the City of Newport Beach for said vacation, closing up and abandonment, by resolution dated aw=4 „.I/ _3 , 1958, and designated "Resolution No. 11aLI, whin said map is on file in the office of the City Clerk of the City of Newport Beach. Reference is hereby made to said map for further particulars as to the proposed vacation, closing up and abandonment 1. �1 IN of said portions of said streets and alleys, and said map is made a part of this Resolution to the same extent and purpose as if the same were herein incorporated in full. SECTION 2: That the proceedings for the closing up and abandonment of the aforesaid portions of said streets and alleys shall be had and taken,and the City Council of the City of Newport Beach hereby elects to proceed under the provisons of the "Street Vacation Act of 1941 ", and all amendments thereto, being Sections 8300 to 8331, inclusive of the Streets and Highways Code of the State of California. SECTION 3: The Street Superintendent of the City of Newport Beach shall cause to be conspicuously posted along the line of the por- tions of said streets and alleys proposed to be vacated not more than 300 feet apart, but not less than three in all, notices of the vacation of said portions of said streets and alleys. Said notices shall state the passage of this Resolution of Intention and the time and place of the hearing of all persons interested in or objecting to the proposed vacation of said portions of said streets and alleys. Said notices shall be so posted at least ten days before the date of said hearing, all as required by law. SECTION 4: The City hereby reserves and excepts from the vacation of said portions of said streets and alleys a permanent ease- ment and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and starm drains and appurtenant structures and all public utilities. These vacation proceedings are taken subject to the reserva- tions and exceptions herein contained. SECTION 5: Notice is hereby given that the City Council of the City of Newport Beach does hereby fix Monday, the 2cf_�4 day of 1958, at the hour of 7:30 o'clock P. M., of said day, in the Council Chambers of the City of Newport Beach, located in the City Hall of the City of Newport Beach, as the time and place for hearing all persons interested in or objecting to the proposed vacation of said portions of said streets and alleys. And the City Council at 2. I' v said time and place will hear the evidence offered by any person inter- ested in the vacation of said portions of said streets and alleys herein- after described. SECTION 6: The portions of said streets and alleys to be vacated abandoned are described as follows: Parcel 1: All that portion of Shore Avenue (formerly known as Ocean Avenue) 50 feet in width as shown upon a map of Corona Del Mar recorded in Miscel- laneous Map Book 3, pages 41 & 42, Records of Orange County, California, and more particularly described as follows, to wit: Beginning at the most westerly corner of Block A -34 as shown upon said map of Corona Del Mar; thence southeasterly along the southwesterly line of said Block A -34 to the most southerly corner thereof; thence southeasterly in a straight line to the most westerly corner of Lot 8, Block A -35 as shown upon said map of Corona Del Mar; thence continuing southeasterly along the northeasterly line of said Shore Avenue to the intersection with the centerline of Larkspur Avenue (formerly known as 37th Avenue) 50 feet in width as shown upon said map of Corona Del Mar; thence southwesterly along said centerline to an intersection with the southwesterly line of said Shore Avenue; thence northwesterly along said southwesterly line of Shore Avenue to an intersection with the southwesterly prolongation of the northwesterly line of aforementioned Block A -34; thence northeasterly along said southwesterly prolongation to the point of beginning. Parcel 2: All that portion of Shore Avenue (formerly known as Ocean Avenue) 50 feet in width as shown upon a map of Corona Del Mar recorded in Miscel- laneous Map Book 3, pages 41 & 42, Records of Orange County, California, and more particularly described as follows; to wit: Beginning at the point of intersection of the southwesterly line of Shore Avenue and the southwesterly prolongation of the centerline of Larkspur Avenue (formerly known as 37th Avenue) 50 feet in width as shown upon said map of Corona Del Mar; thence southeasterly along the southwesterly line of said Shore Avenue, 50 feet in width, to an intersection with the southeasterly line of Narcissus Avenue (formerly known as 40th Avenue) 50 feet in width, as shown upon said.map of Corona Del Mar; thence northeasterly along said southeasterly line to an intersection with a line lying southwesterly of, distant 5 feet from, and parallel with the centerline of said Shore Avenue; thence north- westerly along said parallel line to an intersection with the center- line of said Larkspur Avenue; thence southwesterly along said center- line to the point of beginning. Parcel 3: All that portion of Heliotrope Avenue (formerly known as 34th Avenue) 50 feet in width as shown upon a map of Corona Del Mar, recorded in Miscellaneous Map Book 3, pages 41 & 42, Records of Orange County, California, and more particularly described as follows, to wit: Beginning at the most southerly corner of Block A -34 as shown upon said map of Corona Del Mar; thence northeasterly along the south- easterly line of said Block A -34 to an.intersection with the north- westerly prolongation of the southwesterly line of Lot 26, Block A -35 as shown upon said map of Corona Del Mar; thence southeasterly along 3• J'�S said northwesterly prolongation to the most westerly corner of said Lot 26; thence southwesterly along the northwesterly line of said Block A -35 to the most westerly corner of Lot 8 of said Block A -35; thence northwesterly in a straight line to the point of beginning. Parcel 4: All that portion of Iris Avenue (formerly known as 35th Avenue) 50 feet in width, a certain portion of the alley 12 feet in width, and a por- tion of Lots 8, 12, 14, 16, 18, 20, and 22 of Block A -36 as shown upon a map of Corona Del Mar recorded in Miscellaneous Map Book 3, pages 41 & 42, Official Records of Orange County, California, an easement or right of way for highway purposes having been granted to the City of Newport Beach over said Lots 8, 12, 14, 16, 18, 20, and 22 by Citizens National Trust and Savings Bank of Los Angeles, California, in Grant of Easement recorded the 27th day of November, 1937, in Book 919, Page 164, Official Records of Orange County, California, and more particularly described as follows, to wit: Beginning at the most southerly corner of Lot 1, of Block A -35, as shown upon said map of Corona Del Mar; thence northeasterly along the southeasterly line of said Block A -35 to an intersection with the northwesterly prdcngation of the southwesterly line of Lot A, as shown upon a map of Tract 1026, Miscellaneous Map Book 33, page 38, said Records of Orange County, California; thence southeasterly along said northwesterly prolongation to an intersection with a line lying south- easterly of, distant 80 feet from, and parallel to the northwesterly line of said Iris Avenue; thence southwesterly along said parallel line to an intersection with the southwesterly line of said Block A -36; thence northwesterly along said southwesterly line to its northwesterly prolongation to the point of beginning. Parcel 5: All that portion of Jasmine Avenue, (formerly known as 36th Avenue) 50 feet in width as shown upon a map of Corona Del Mar, Recorded in Mis- cellaneous Map Book 3, pages 41 & 112, Official Records of Orange County, California, and more particularly described as follow, to wit: Beginning at the most southerly corner of Lot 1, of Block A -36 as shown upon said map of Corona Del Mar; thence northeasterly along the southeasterly line of said Block A -36 to the most easterly corner of Lot 15, of said Block A -36; thence southeasterly in a straight line to the most northerly corner of Lot 16, Block A -37 as shown upon said map of Corona Del Mar; thence southwesterly along the northwesterly line of said Block A -37 to the most westerly corner of Lot 8 of said Block A -37; thence northwesterly in a straight line to the point of beginning. Parcel 6: All that portion of Larkspur Avenue (formerly known as 37th Avenue) 50 feet in width as shown upon a map of Corona Del Mar, recorded in Mis- cellaneous Map Book 3, pages 41 & 42, Official Records of Orange County, California, and more particularly described as follow, to wit: Beginning at the most southerly corner of Lot 1, Block A -37 as shown upon said map of Corona Del Mar; thence northeasterly along the south- easterly line of said Block A -37 to the most easterly corner of Lot 15 of said Block A -37; thence southeasterly on the prolongation of the northeasterly line of said Lot 15 to an intersection with the centerline of said Larkspur Avenue; thence southwesterly along the said centerline to an intersection with the southeasterly prolongation of the southwest- erly line of said Block A -37; thence northwesterly along said south- easterly prolongation to the point of beginning. 4. Lin iii Parcel 7: All that portion of the alley, 12 feet in width and Lots 9 and 10 of Block A -35 as shown upon a map of Corona Del Mar recorded in Miscel- laneous Map Book 3, pages 41 & 42, Official Records of Orange County, California, an easement or Right of Way for highway purposes having been granted over said Lots 9 and 10 by Grant of Easement to the City of Newport Beach by the Citizens National Trust and Savings Bank of Los Angeles, California, by Grant of Easement recorded the 27th day of November, 1937, in Book 919, Page 164, Official Record of Orange County, California, said land being part of a public dedicated street known as Wave Street, and more particularly described as follow, to wit: Beginning at the most northerly corner of Lot 8 of Block A -35 as shown upon said map of Corona Del Mar; thence northeasterly in a straight line to the most westerly corner of Lot 12 of said Block A -35; thence southeasterly in a direct line to the•mobt southerly corner of Lot 11 of said Block A -35; thence southwesterly in a straight line to the most easterly corner of Lot 1 of said Block A -35; thence north westerly along the northeasterly line of Lots 1 to 8 inclusive, of said Block A -35 to the point of beginning. Parcel 8: All that portion of the alley and Lots 9 and 10 of Block A -36 as shown upon a Map of Corona Del Mar recorded in Miscellaneous Map Book 3, pages 41 & 42, Official Records of Orange County, California, an easement or Right of Way for highway purposes having been granted over said Lots 9 and 10 by Grant of Easement to the City of Newport Beach by the Citizens National Trust and Savings Bank of Los Angeles, California by Grant of Easement recorded on the 27th day of November,1937, in Book 919, Page 164, Official Records of Orange County, California, said land being part of a public dedicated street known as Wave Street, and more particularly described as follows, to wit: Beginning at the most southerly corner of Lot 11, Block A -36; thence southwesterly in a straight line to the most easterly corner of Lot 1 of said Block A -36; thence northwesterly along the northeasterly line of Lots 1 to 8 inclusive, in said Block A -36 to an intersection with a line lying southeasterly of, 80 feet distant from, and parallel to the southeasterly line of Block A -35 as shown upon said map of Corona Del Mar; thence northeasterly along said parallel line to an intersection with the southwesterly line of Lot 12 of the aforementioned Block A -36; thence southeasterly in a direct line to the point of beginning. Parcel 9: All that portion of Narcissus Avenue (formerly known as'40th Avenue) 50 feet in width as shown upon a map of Corona Del Mar, recorded in Mis- cellaneous Map Book 3, pages 41 & 42, Records of Orange County, Cali- fornia and more particularly described as follows, to wit: Beginning at the most southerly corner of Lot A of Tract 1257 as shown upon a map recorded in Miscellaneous Map Book 38, page 25, Records of Orange County; thence southeasterly along the prolongation of the southwesterly line of said Lot A to the intersection with the southeasterly line of said Narcissus Avenue; thence southwesterly along said southeasterly line of Narcissus Avenue to the intersection with a line parallel to, and 5 feet southwesterly, measured at right angles, from the centerline of Shore Avenue (formerly Ocean Avenue) 50 feet in width, as shown upon said map of Corona Del Mar; thence northwesterly along said parallel line to the intersection with a line parallel to and 5 feet southeasterly, measured at right angles, from the centerline of said Narcissus Avenue; thence northeasterly in a direct line to the point of beginning. 5. SECTION 7: This Resolution of Intention shall be published at least once in the Newport Harbor News Press, a newspaper of general circulation, printed, published and circulated in the City of Newport Beach, and said publication shall be made before the date set for the hearing of all persons interested in or objecting to the proposed va- cation.
