HomeMy WebLinkAbout4868 - Refuse, Garbage and Cuttings Collection141.`C:mec 10/14%58 /6y RESOLUTION NO. 4t L j A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ESTABLISHING FREQUENCY OF • COLLECTION AND FEES FOR THE COLLECTION OF REFUSE, GARBAGE AND CUTTINGS • WHEREAS, the City of Newport Beach is providing the service of collecting refuse, garbage and cuttings in the City; and WHEREAS, it is necessary to establish and collect fees for said service in accordance with the provisions of Article V of the Newport Beach Municipal Code; NOW, THEREFORE, BE IT RESOLVED: Section 1. Residential Premises. Twice - weekly Collections. Collections shall be provided twice weekly from all single and mul- oiNxr rCOlCicnblal Nrelniaes in cne City for which a collection service is not provided by a sanitary district. Single residential premises means a separate lot or parcel of land with one residential unit on it. Multiple residential premises means a separate lot or parcel of land with two separate residential units, one or more duplexes, triplexes, apartment houses, motels, courts, trailer parks, hotels, cottages or any other type of residential occupancy on it which is not receiving or determined by the City Manager, Street Superintendent or other person administering the collection service to need six (6) day service. Section 2. Business Premises, Twice - weekly Collections. Collections shall be provided twice weekly from all single business and multiple business premises in the City for which a collection service is not provided by a sanitary district. Singlo buuiness premises means a separate lot or parcel of land with a single business unit on it. Multiple business premises means a separate • lot or parcel of land with two or more business units on it not receiving or determined by the City Manager, Street Superintendent or other person administering the collection service to need six (6) day service. Section 3. Twice - weekly Collections - Fees. For each single residential premises, for each single business premises 1. and for premises with any other type of single occupancy, the fee shall be $1.25 per month. For each multiple residential premises, • for each multiple business premises or for any combination of • residential and business premises or premises with any other type of multiple occupancy, the fee shall be $1.25 per month for the first residential, business or other unit and $0.50 per month for each additional residential, business or other unit on the same premises. For the above fees, up to six (6) cans per week will be collected from any premises. If additional cans per week are needed, such additional cans will be collected for $0.20 per month each up to the limit on such extra cans set by the City Manager, Street Superintendent or other person administering the collection service. The limit set shall be based upon storage space available and the type of garbage or refuse generated. A can is a receptacle for garbage not exceeding a capacity of eight (B) gallons or a receptacle for refuse or cuttings that does not exceed forty -five (45) gallons in capacity or fifty (50) pounds in weight. Section 4. Credit for Vacancies. Upon presentation of evidence satisfactory to the Director of Finance within thirty (30) days after a bill is rendered that a unit mentioned in Section 3 was vacant for any period of thirty (30) consecutive days during the billing, period for which such bill was rendered, credit shall be allowed and such bill or the bill next rendered reduced by an amount equal to the number of such periods of vacancy multiplied by $0.50 for each such vacant unit. If such bill has been paid and future bills for the same premises will not be rendered to the person paying the same, a refund of such amount • may be made. • Section 5. Commercial Collections. Collections shall be made six (6) times weekly from business premises and other types of occupancy where six (6) day service is requested and from individual businesses or business or multiple residential premises or premises with other type occupancy where the City 0 • • • • Manager, Street Superintendent or other person administering the collection service determines that because of the nature of the business or the quantity or content of the garbage or refuse six (6) day service is necessary. The fee shall be $0.15 per can per pickup. The minimum fee per month for this service shall be $3.90. A standard fee based upon average quantity may be negotiated for each business receiving six (6) day service. Section 6. Billing. Fees established by this resolu- tion shall be billed by the Finance Department directly to the persons in charge of the premises or occupancy unit for which the service is provided. The fees are payable on the first day of the month following the date of the bill and are delinquent on the twenty -fifth day of such month. The fees may be included on the bill with the water charges or billed separately. If included with the water charges the fees shall be billed for a bimonthly period. Section 7. Effective Date. The fees hereby established shall be effective beginning November 15, 1958.
