• 2 A RESOLUTION OF THE CITY COUNCIL. OF THE CITY
OF NEWPORT BEACH.AUTHORIZING THE EXECUTION OF
• 3 AN AGREEMENT

5 WHEREAS, the City.of Newport Beach and John Charles Kirk
6 have -an agreement by which the City grants to Kirk a privilege and
7 license to operate a concession on Balboa Pier, the ending date
8 of which agreement is August 31, 1960 ;', and
9 WHEREAS, it appears that it would be to the mutual adm
10 vantage of the parties to enter into an agreement extending the
11 term of said privilege and license through December 31, 1960; and
12 WHEREAS, such an agreement has been presented to the City,
13 Council of the City of Newport Beach and the City Council has con -
14 sidered the terms and conditions thereof and found them to be fair
15- and equitable;
16 NOW, THEREFORE, BE IT RESOLVED that said agreement betwee:
17 the City of Newport Beach and John Charles Kirk extending the term
18 of the agreement between the parties dated the 1st day of September
19 1955, through December 31, 1960, be approved, and the Mayor and Cit
20' Clerk are authorized and directed to execute the same on behalf of
21 the City of Newport Beach.
22 This resolution was adopted by the City Council of the
23 City,of Newport Beach at a regular meeting on the llthday of
24 January, 1960, by the following vote, to wit:
25 AYES, COUNCILMEN: Atkinson, Higbie,
26 Stoddard, Hart, Lorenz, Somers
27 NOES, COUNCILMEN-' None
28 ABSENT COUNCILMEN: Kingsley

of the City of Newport Beach filed and maintained in my office,
the foregoing Resolution No. 5149 was duly and
regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
the 11th day of January 1960 by the following
vote, to wit:
