HomeMy WebLinkAbout5164 - Vacation of Alley2%8%6gl(12) RESOLUTION NO. 5Ib 2 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING ITS 3 INTENTION TO ORDER THE CLOSING UP, VACATION AND ABANDONMENT-OF A PORTION OF AN ALLEY, 4 RUNNING NORTHERLY FROM SHORT STREET BETWEEN NEWPORT BOULEVARD AND CLUBHOUSE AVENUE 5 6 The City. Council of the City of Newport Beach, pursuant 7 to the provisions of the "Street Vacation Act of 1941 ", and all 8 amendments thereto, being Sections 8300 to 8331, inclusive, of 9 the Streets and Highways Code of the State of California, does 10 hereby resolve and declare as follows: 11 SECTION 1: The public interest and convenience require 12 the closing up and abandonment of a portion of a certain alley 13 running northerly from Short Street between Newport Boulevard and 14 Clubhouse Avenue in the City of Newport Beach, and it is the inten- 15 tion of the City Council of the City of Newport Beach to order the 16 following described portion of said alley in the City of Newport 17 Beach, County of Orange, State of California, to be vacated, closed 1811and abandoned, to wit: 19 I That portion of the alley 10 feet in width adjacent to Lot 7, Block 634, as shown upon a map of Canal Section, 20 recorded in Miscellaneous Maps, Book 4, page 98, records of Orange County, California, and more particularly 21I described as follows: 22 Beginning at the most southerly corner of said 23 Lot 7; thence southeasterly along the southeast - erly prolongation of the southwesterly line of said Lot 7, 2.27 feet, more or less, to an inter= 24 section with the easterly line of State Highway 25 ORA -43, said easterly line being a curve.concave to the east and having a radius of 1048.00 feet; thence along said curve in a northerly direction 26 11.59 feet, more or less, to the intersection with the easterly line of said Block 634, Canal 27 Section; thence southerly along said easterly line to the point of beginning. 28 2911 All of that portion of said alley to be vacated, closed up 3011 and abandoned is more clearly shown on a certain map approved and 3111 adopted by the City Council of the City of Newport Beach for said 3211 vacation, closing up and abandonment, by resolution dated February 8 1 1960, and designated GPResolution No. f-/C3 °B, which said map is on • 2 file in the office of the City Clerk of the City of Newport Beach. 3 Reference is hereby made to said map for further particulars as to • 4 the proposed vacation, closing up and abandonment of said portion 5 of said alley, and said map is made a part of this resolution by 6 this reference to the same extent and purpose, as if it were in- 7 eorporated herein in full. 8 SECTION 2: The proceedings for the closing up and aban- 9 donment of the aforesaid portion of said alley shall be had and 10 taken, and the City Council of the City of Newport Beach hereby 11 elects to proceed under the provisions of the C4Street Vacation Act 12 of 1941 ", and all amendments thereto, being Sections 8300 to 8331, 13 inclusive, of the Streets and Highways Code of the State of 14 California. 15 SECTION 3: The Street Superintendent of the City of 16 Newport Beach shall cause to be conspicuously posted along the line 17 of the portion of said alley proposed to be vacated not more than 18 300 feet apart, but not less than three in all, notices of the 19 vacation of said portion of said alley. Said notices shall state 20 the passage of this Resolution of Intention and the time and place 21 of the hearing of all persons interested in or.objecting to the 22 proposed vacation of said portion of said alley. Said notices 23 shall be so posted at least ten days before the date of said hear - 24 ing, all as required by law. 25 SECTION 4> Notice is hereby given that the City Council 26 of the City of Newport Beach does hereby fix Monday, the 14th day 27 of Narch, 1960, at the hour of 7:30 o'clock P. M. of said day, in • 28 the Council Chambers of the City of Newport teach, located in the 29 City Hall of the City of Newport Beach, as the time and place for 30 hearing all persons interested in or objecting to the proposed 31 vacation of said portion of said alley, and the City Council at 32 said time and place will hear the evidence offered by any person P. I 111 interested in the vacation of said portion of said alley hereinbef • 2 described. 3 SECTICH 5: This Resolution of Intention shall be pub - • 4 lisped at least once in the Newport Her.bor Nears Press, a newspaper 5 of general circulation, printed, published and circulated in the 6 City of Newport Beach, and said publication shall be made before 7 the date set for the hearing of all persons interested in or 8 objecting to the proposed vacation. 9 This resolution was adopted by the City Council of the 10 City of Newport Beach at a regular meeting on the 8th day of 11 February, 1960, by the following vote, to wit: 12 AYES, COUNCIL14EN: 13 SL, _' A' ILL), 48 14 NOES, COUNCIUMN: 15.
