HomeMy WebLinkAbout5538 - Vacation of Alley in Seashore Colony Tract0 in 2 3 4 5 6 7 [7 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 omec /62 (12) l76 -6z RESOLUTION NO. 3 S 3 sl A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ORDERING THE VACATION, CLOSING UP AND ABANDONMENT OF A PORTION OF AN ALLEY IN BLOCK 2 OF SEASHORE COLONY TRACT WHEREAS, the City Council of the City of Newport Beach did, on the 13th day of November, 1961, pass its certain Resolut of Intention No. 5514, declaring its intention to order the vaca- tion, closing up and abandonment of a portion of a certain alley in Block 2 of Seashore Colony Tract in the City of Newport Beach, hereinafter more particularly described, pursuant to and in accor4 ance with the 9°Street Vacation Act of 194140, and all amendments thereto, being Sections 8300 to 8331, inclusive, of the Streets and Highways.Code of the State of California; and WHEREAS, the Street Superintendent of the City of Beach.has caused to be posted conspicuously along the line of the portion of said alley proposed to be vacated, not more than 300 feet apart, and not less than three in all, notices of the vaca- tion of said portion of said alley, all of which will more fully appear from the affidavit of Joseph T. Devlin, Street Superintend- ent of the City of Newport Beach, on file in these proceedings; and WHEREAS, said notices so posted by the Street Superin- tendent of the City of Newport Beach stated the. passage of said Resolution of Intention No. 5514 aforesaid, and the time and place of the hearing of all persons interested in or objecting to the proposed vacation of said portion of said alley; and WHEREAS, the City Council of the City of Newport Beach did set Monday, December 11, 1961, at 7;30 Po Me of said day as the time, and the Council Chamber of the City Council of the City of Newport Beach, located in the City Hall of the City of Newport Beach, as the place, for the hearing of all persons interested in or objecting to the proposed vacation of said portion of said 1 alley; and 2 WHEREAS, said Resolution of Intention No. 5514 aforesaid 3 has been published at least once in the Newport Harbor News Press, 4 a newspaper of general circulation, printed, published and circus 5 lated in the City of Newport Beach, and said publication was made 6 more than 15 days prior to the date set for the hearing of all 7 persons interested in or objecting to the proposed vacation, all 8 of which will more fully appear by the affidavit of Ben Reddick, 9 owner and publisher of said Newport Harbor News Press, on file in 10 these proceedings; and 11 MURBAS, said hearing was opened on December 11, 1961, 12 and was thereafter continued to December 26, 19619 at which time 13 additional evidence was taken; and 14 WHEREAS, the City Council of the City of Newport Beach 15 has heard the evidence, both written and verbal, of all persons 16 interested in the vacation of said portion of said alley in this 17 resolution more particularly hereinafter described, and finds fron 18 all the evidence submitted that said portion of said alley descrig 19 in said Resolution of Intention, and hereinafter described, is 20 unnecessary for present or prospective public street purposes; 21 NOW THEREFORE, the City Council of the City of Newport 22 Beach finds and determines and hereby orders that the following 23 described portion of that certain alley in Block 2 of Seashore 24 Colony Tract in the City of Newport Beach, to wit: . 25 The northeasterly 165 feet of that certain alley, 10 feet in width, in Block 2 of Seashore Colony 26 Tract, in the County of Orange, State of California, as shown on a map recorded in Book 7, page 25 of 27 Miscellaneous Flaps, in the office of the County Recorder of said County, 28 29 is unnecessary for present or prospective public street purposes, 30 and that it be vacated, closed up and abandoned. 31 The City Council further finds and determines, and it is 32 hereby ordered, that the public easement in the portion of said 2. .
