HomeMy WebLinkAbout5540 - General Municipal Election 4-10-62WWC.mec 1/22/62 RESOLUTION NO. 5 O A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ANNOUNCING A GENERAL MUNICIPAL ELECTION TO BE HELD ON THE 10TH DAY OF APRIL, 1962, SETTING FORTH THE OFFICES TO BE FILLED, ORDERING THE SUBMISSION OF A PROPOSED AMENDMENT TO THE CHARTER OF THE CITY OF NEWPORT BEACH TO BE SUBMITTED TO THE ELECTORS OF SAID CITY AT SAID GENERAL MUNICIPAL ELECTION, APPOINTING ELECTION OFFICERS AND ESTABLISHING THEIR COMPENSATION, DESIGNATING POLLING PLACES AND PROVIDING FOR THE - OPENING AND CLOSING OF THE POLLS FOR SAID GENERAL MUNICIPAL ELECTION WHEREAS, the Charter of the City of Newport Beach requires a general municipal election to be held on the 10th day of April, 1962, for the election of four members of the City Council for regular terms of four years from the following districts, to wit: Second District, Third District, Fourth District, and Seventh Dis- trict; and WHEREAS, the City Council of the City of Newport Beach, in accordance with the provisions of Section 8 of Constitution of the State of California, on its of posing an amendment to the Charter of the City of to be submitted to the qualified electors of said general municipal election to be held on Tuesday, April, 1962; Article X1 of the an motion is pro - Newport Beach City at the the 10th day of NOW, THEREFORE, the City Council of the City of Newport Beach does hereby resolve, declare, determine and order as follows: SECTION 1. There shall be held in the City of Newport Beach on Tuesday, the 10th day of April, 1962, a general municipal election of the qualified electors of said City for the purpose of electing four members of the City Council from the following dis- tricts, to wit: Second District, Third District, Fourth District, • and Seventh District, for the full term of four years in accordance with the Charter of the City of Newport Beach. SECTION 2. At the said general municipal election to be held on Tuesday, the 10th day of April, 1962, there shall be sub- mitted to the qualified electors of the City of Newport Beach the following proposed charter amendment, to wit: CHARTER AMENDMENT The exact form of the ballot proposition to submit the ,. proposed charter amendment to the qualified electors of the City of Newport Beach, with the language enclosed by the lines appearing on the ballot, is as follows: PROPOSED CHARTER AMENDMENT: Shall Section 415 of the Charter be amended to YES confirm the authority of the City to revise, recompile, recodify and index the Newport Beach j Municipal Code and adopt the same by reference NO by the passage of an ordinance for that purpose? A cross ( +) placed in the voting square after the word "YES" as set out above shall be counted in favor of the adoption,of the proposed charter amendment. A,cross (+) placed in the voting square after the word "No" as set out above shall be counted against the adoption of the proposed charter amendment. Should the proposed charter amendment receive a favorable vote and be approved, Section 415 of the Charter shall be amended to read as follows: "Section 415. Codification of Ordinances. Any or all or 3nances of the City which have been enacted and published in the manner required at the time of their adoption, and which have not been repealed, may be com- piled, consolidated, revised, indexed and arranged as a comprehensive ordinance code, and such code may be adopted'by reference, with the same effect as an ordi- nance, by the passage of an ordinance for'such purpose. Such code need not be published in the manner required for other ordinances, but not less than three copies thereof shall be filed for use and examination by the . public in the office.of the City Clerk prior to the adoption thereof. Ordinances codified shall be repealed as of the'effective date of the code. Such code may be r*3;1 manner as ordinances. 2. code Detailed regulations pertaining to 'the.construction ' of buildings, plumbing and wiring, when arranged as a compre- hensive code, may likewise be'adopted by reference in the - manner provided in this Section. Maps, charts and diagrams also may be adopted by 'reference in the same manner." (Underlined words are those being added by the amendment.) SECTION 3. The ballots to be used at said election shall be, both as to form and matter contained therein, such as may be required by law to be used. SECTION 4. The City Clerk of said City is hereby author- ized, instructed and directed to procure, give, make and furnish any and all official ballots, notices, publications and printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct said election. SECTION 5. For the purpose of holding said general muni- cipal election, there shall be forty (40) voting precincts within the said City consisting of either'regular election precincts es- tablished for holding State or County elections, or a consolidation of some or all of such precincts. The respective precincts, polling places of said respective precincts, and the respective boards of election for said respective precincts,are hereby fixed, designated, appointed and established as follows: VOTING PRECINCT 1, comprising State and County precincts numbers 1, 55 and 77. All of the persons hereinabove named as elec- tion officers are hereby appointed as such election officers, respectively, and their compensation is hereby fixed at the sum of $21.00 for each Inspector, and $18.00 for each Judge and Clerk, for said election. The rental for each of such polling places where a charge is made shall be the sum of $10.00 for said election. SECTION 7. The polls for said election shall be open at seven o'clock A. M. of the day of said election, and shall remain • open continuously from said time until seven o'clock P. M. of the same day, when said polls shall be closed, except as provided in Sections 14436 and 14437 of the Elections Code of the State of California. 13. SECTION 8. In all particulars not recited in this reso- lution, said election shall be held and conducted as provided by law for holding municipal elections in said City. SECTION 9. The City Clerk of said City As hereby author- ized and directed to give notice of said election in the time, form and manner as required by law and to give any further or additional notice of said election in time, form and manner as required by law and to advertise said Charter Amendment in accordance with Section 8 of Article XI of the Constitution of the State of Cali - fornia and to perform such other acts as are necessary to conduct said election in accordance with law, and shall cause to be printed, on plain white paper, without watermarks, at least as many copies of the form of ballot provided and used in each voting precinct as there are voters in the precinct. Such copies shall be designated ,1 as ".Sample Ballot" upon their face. Said City Clerk shall commence to mail one Sample Ballot, postage prepaid, to each voter not more than 40 nor less than 15 days before said 10th,day of April, 1962. The mailing of said Sample Ballots shall be completed at least 10 whole days before said day of election. The number of such Sample Ballots printed shall not exceed the total registration by more than fifteen per cent (15 %). Said City Clerk shall also enclose in the envelope with each of said Ballots arguments on measures and other matters required by law, including a card stating the location of the precinct's polling place of each voter. Only of- ficial matter shall be sent in such envelope.
