1 RESOLUTION NO. 5550
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF
3 COVENANTS, CONDITIONS,.AND RESTRICTIONS BEING
IMPOSED UPON TRACT NO. 4444

5 WHEREAS, there has been presented to the City Council of
6 the City of Newport Beach by Resplan.. Inc., subdivider of Tract No.
7 4444, a document entitled 88Declaration of Covenants, Conditions and
8 Restrictions90, whereby covenants, conditions, and restrictions are
9 imposed upon all lots in Tract No. 4444-is covenants running with
10 the land; and
11 WHEREAS, Resplan, Inc., is the owner of all lots in
12 Tract No. 4444 and proposes to impose said Declaration of Covenants
13 Conditions and Restrictions upon said tract for the benefit of all
14 of the lots therein and for the benefit of the adjoining land
15 owned by the City; and
16 WHEREAS,.the City of Newport Beach is the owner in fee of
17 the land within Tract No..4444 dedicated for street purposes; and
18 WHEREAS, the City Council has reviewed said document and
19 determined that it adequately provides for the permanent upkeep,
20 maintenance, and payment of taxes of Lot 34 of Tract No. 4444, as
21 required by Section 9256.13 of the Newport Beach Municipal Code;
22 NOW, THEREFORE, BE IT RESOLVED that the Mayor and City
23 Clerk be and are hereby authorized and directed to execute the
24 same on behalf of the City of Newport Beach.
25 ADOPTED this 5th day of Februar 1962.
