1 RESOLUTION N0. 5557
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUT- RORIZING THE EXECUTION OF AN
3 AGREEMENT WITH PACIFIC ELECTRIC RAILWAY COMPANY,
SUBDIVIDER, FOR THE CONSTRUCTION OF IMPROVEMENTS
4 IN TRACT NO.3813
6 WHEREAS, there has been presented to the City Council of
7 the City of Newport Beach an agreement in which Pacific Electric
8 Railway Company, subdivider of Tract No. 3813, agrees to construct
9 street and other public improvements necessary to serve said sub -
10 division; and
11 WHEREAS, subdivider has furnished security to assure the
12 faithful performance under said agreement in accordance with the
13 Newport Beach Municipal Code; and
14 WHEREAS, the City Council has reviewed said agreement
15 and found the same to be fair and equitable and in accordance with
16 the provisions of the Code;
17 NOW, THEREFORE, BE IT RESOLVED that said contract is
18 approved upon condition that the Director of Public Works reviews
19 and approves the improvement plans which are incorporated in said
20 contract by reference, and that the Mayor and City Cleric be and
21 are hereby authorized and directed to execute the same upon such
22 approval of said plans and at such time as said security is approv
23 by the City Manager as to sufficiency and the City Attorney as to
24 form.
