5 IR -=/AS, the City Council has this date adopted Resolutia
6 No. 5709 E,hich authorizes the execution of an Indenture approving
7 a building encroactment over a sidewalr. and utility easement held
8 by the City over Lot 1 of Tract No. 1080; and
9 FnrMREAS, an Agreement has also been prepared wahich
10 requires Sidney Kibrick, doing business as Triangle Subdivisions,
11 the prospective owner of said Lot 1, as a condition of constructing
12 the proposed building encroaching over said easement to do certain
13 additional construction work in the easement area whictz is neces-
14 sary and in the public interest; and
15 t, S, the City Council has reviewed the terms of said
16 Agreement and found the same to be fair and in the public interest;
17 NOI7 T12RE801,1E, RE IT RESOLVED that the tl3ayor and City
18 Clerk be and are hereby authorized and directed to execute the
19 same on behalf of the City of Newport Beach.
