6 The City Council of the City of Newport Beach, pt=suant
7 to the provisions of the "Street Vacation Act of 1941 ", and all
8 amendments thereto, being Sections 8300 to 8331, inclusive, of
9 the Streets and Highways Code of the State of California, does
10 hereby resolve and declare as follows:
11 SECTION 1. The public interest and convenience require
12 the closing up and abandonment of a portion of a certain alley
131 east of Tustin Avenue between Del Mar Avenue and Anniversary Lane
14 in the City of Newport Beach, and it is the intention of the City
15 'ouncil of the City of Newport Beach to order the following
16 described portion of said alley in the City of Newport Beach,
17 County of Orange, State of California, to be vacated, closed up
18 1 and abandoned, to gait
19 The northeasterly l foot of the southeasterly 610
20 feet of the northeasterly alley, 28 feet in width, of
Tract No. 4444 in the City of Neeraort Beach, County
21 of Orange, State of California, as per map recorded
in Book 156, page 11 of Miscellaneous Maps in the
22 office of the County Recorder of said County. For
the purpose of this description, the southeasterly
23 line of said alley is the southeasterly line of said
24.1 Tract.

25 All of that portion of said alley to be vacated, closed
26 up and abandoned is more clearly shown on a certain crap approved
27 and adopted by the City ouncil of the City of Ne-,P?ort Beach for
28 said vacation, closing =nap and abandonment, by resolution dated
29 January 28, 1953, and designated "Resolution No. `i 1 CP, which
30 said map is on file in the office of the City Clerk of the ity of
31 Newport Beach. Reference is hereby made to said map for further
32 particulars as to the proposed vacation, closing up and abandonment

of said portion of said alley, and said map is made a part of this
resolution by this reference to the sane extent and purpose as if
it were incorporated herein in 1111.
SECTION 2. The proceedings for the closing up and aban-
donment of the aforesaid portion of said alley shall be had and
taken, and the City Council of the City of Newport Beach hereby
elects to proceed under the provisions of the "Street Vacations Pict
of 1941 ", and all amendments thereto, being Sections 8300 to 8331,
inclusive, of the Streets and Highways Code of the State of Cali-
fornia.
SECTION.3. The Street Superintendent of the City of
Newport Beach shall cause to be conspicuously posted along the line
of the portion of said alley proposed to be vacated not more than
300 feet apart, but not less than three in all, notices of the
vacation of said portion of said alley. Said notices shall state
the passage of this Resolution of Intention and the time and ;slate
of the hearing of all persons interested in or objecting to the
proposed vacation of said portion of said alley. Said notices
shall be so posted at least ten days before the date of said
hearing, all as required by last.
SECTION 4. There is hereby reserved and excepted from
the vacation of said portion of said alley a permanent easement and
right at any tame, or from time to time, to construct, maintain,
operate, replace, remove and renew sanitary sewers and appurtenant
structures in, upon, over and across a 6-foot aside portion of the
portion of said alley proposed to be vacated, the center line of
said easement being the southerly prolongation of the commons lot
line between Lots 22 and 23 of Tract No. 3068 as per mays recorded is
Book 93, page 9, of Miscellaneous Maps in the office of the County
Recorder of Orange County, California.
These vacation proceedings are taken subject to the
reservations and exceptions herein contained.

SECTION 6. This Resolution of Intention shall be v b-
lished at yeast once in the official newspaper of the City, and
said purl cation shall be made before the date set for the heaving
of all persons interested in or objecting to the proposed vacatio .
