HomeMy WebLinkAbout5901 - Public Works Contract1 /1V /64 (8) 1 RESOLUTION NO. 5901 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEG7PORT BEACH AUTHORIZING A PUBLIC WORKS CONTRACT 3 WITHOUT ADVERTISING FOR BIDS 5 WHEREAS, Section 1110 of the Charter requires every . 6 project for the construction or improvement of public works to be 7 done by contract awarded to the lowest responsible bidder after 8 notice by publication; and 9 WHEREAS, said section contains an exception authorizing 10 a contract without advertising for bids where such work is deemed 11 by the City Council to be of urgent necessity for the preservation 12 of life, health or property and is authorized by resolution by five 13 affirmative votes of the Council and contains a declaration of the 14 facts constituting the urgency; and 15 WHEREAS, it is necessary to construct and install addi- 16 tional drainage facilities as follows; 17 11 Construct new drainage catchbasins at the inter - 18 section of Bayside Drive and Carnation Avenue and connect 19 them to the existing underground storm drain located adjacent 20 to the intersection. 21 2. Construct a new drainage catchbasin and enlarge 22 the existing drainage catchbasin on the southerly side of 23 Bayside Drive westerly of Goldenrod Avenue and connect the 24 new drainage catchbasin to the existing underground storm 25 drain located on the northerly side of Bayside Drive. 26 3. Construct new drainage catchbasins on the southerly 27 side of Bayside Drive westerly of Heliotrope Avenue and 28 ,jasmine Avenue and connect to existing underground storm 29 drains in Bayside Drive. 30 4. Construct new drainage catchbasins on the northerly 31 side of Via Lido Nord at ilia San Remo and at Via Waziers, and 32 install new underground storm drains from each new catchbasin 1 to Newport Bay; 2 and 3 WHEREAS, the City Council finds such work to be of urgent 4 necessity for the preservation of life, health and property and 5 declares the facts constituting the urgency to be as follows: 6 Recent rainstorms have indicated the existing drainage 7 facilities for the above described areas are inadequate to conduct 8 surface waters from the public streets to Newport Bay and as a 9 result large quantities of water accumulate on the surface of the 10 public streets and threaten damage to both public and private 11 property, additional rainstorms can be expected, and it is essen- 12 tial that the required facilities be constructed as early as 13 possible to preserve and protect such property; 14 NOU; THMEFORE, based upon the foregoing, the City Council 15 awards a contract to construct and install additional drainage 16 facilities to iezowski & Markel, a partnership, for the contract 17 price as specified in its informal bid dated January 13, 1964, whick 18 is hereby adopted and made a part of this resolution by this refer - 19 ence, 20 BE IT FURTIM RESOLVED that the Mayor and City Clerk be 21 and are hereby authorized and directed to execute a formal contract 22 setting out the terms of said bid and this resolution, 23 This resolution was adopted by at least five (5) affirma- 24 tive votes of the City Council of the City of Newport Beach at a 25 regular meeting held on the 13th day of January, 1964, by the fol- 26 losing vote, to wit: 27 AXES, COUNCIIAMENe a c 1 28�115�� 29 NOES, COUNCII,MENo 30 °` �� ABSENT CO CI4NdE - -- ATTEST: Mayor 32 City Clerk _ 2, 0 STATE OF CALIFORNIA ) COUNTY OF ORANGE ) CITY OF NEWPORT BEACH) +9' I, MARGERY SCHROUDER, City Clerk of the -City of Newport Beach, California, do hereby certify that according to the records of the City of Newport Beach.£iled and maintained in my office, the foregoing Resolution No. 5901 was duly and regularly adopted, passed, and approved by the City Council of the City of Newport Beach,.
