1 RESOLUTION NO. ..5- %/ 7
2 A RESOLUTION OF THE CITY COUNCIL OF TIME CITY OF
NDIPORT BEACH ACCEPTING A GRANT DEED FROM THE
3 IRVINE COMPANY AND THE BLUFFS CONVEYING FEE TITLE
4 TO PUBLIC STREET RIGHTS -OF=%TAY IN TRACT NO. 5463
5 WHEREAS, the Final Map of Tract No. 5463 has been approved
6 by the City Council; and
7 WHEREAS, Section 9256.14(a) of the Newport Beach Muni -
8 cipal Code requires that the subdivider shall convey the real
9 property consisting of the public street and alley rights-of-way
10 surrounding a planned residential development to the City in fee
11 and shall covenant therewith that the open space or recreational
12 area lots shall be continuously maintained for the exclusive use
13 and benefit of occupants of the family dwelling units in the sub -
14 division and that access and automobile storage shall be provided;
15 and
16 AREAS, The Irvine Company, a West Virginia corporation,
17 as owner, and The Bluffs, a limited partnership, as its lessee,
J-6 delivered a grant deed conveying to the City all such real
19 property within said Tract No. 5463 to comply with said Section
20 9256.14(a) , which grant deed was accepted by the City Council by
21 Resolution No. 5897 but has not been recorded; and
22 FrTFEREAS, The Irvine Company, a West Virginia corporation,
23 as owner, and The Bluffs, , a limited partnership, as its lessee,
24 have delivered a revised grant deed conveying to the City all such
25 real property within said Tract No. 5463 to comply with said
26 Section 9256.14(a); and
27 WHEREAS, the City Council has reviewed said document and
28 determined that it adequately provides for the requirements of said
29 Section 9256.14(x);
30 NM82 THEREFORE, BE IT RESOLVED that Resolution No. 5697
31 be rescinded, and the City Council of the City of Newport Beach does
32 accept said revised grant deed and the City Clerk is authorized and

I directed to execute and attach thereto a certificate of acceptance
2 and consent to its recording and to record said grant deed in the
3 County Recorder's office,
