RESOLUTION N0. 6513
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DECLARING THAT WEEDS AND OTHER
PUBLIC NUISANCES EXIST UPON STREETS, ALLEYS,
SIDEWALKS, PARKWAYS, AND PRIVATE PROPERTY WITHIN
THE CITY DECLARING THAT SAID HEEDS AND PUBLIC -
NUISANCEA MUST BE ABATED, SETTING.-THE TIME AND
PLACE FOR A PUBLIC HEARING AT WHICH, THE. CITY :
COUNCIL WILL CONSIDER PROTESTS FROM PERSONS OB-
JECTING TO.THE PROPOSED DESTRUCTION OR REL40VAL
OF SUCH PUBLIC NUISANCES-BY THE CITY, AND DI-
RECTING THE .FIRE CHIEF TO.GIVE NOTICE OF.THE
PASSAGE OF THIS RESOLUTION AND OF THE PUBLIC
FEARING
10 11HEREASs it has come to the attention of the City Council
11 that the following conditions exist upon streets, alleys, sidewalks,
12 parkways and private property within the City as shown, described
13 and delineated on the several maps of the properties in the City
14 which are recorded in the office of the County Recorder of the
15 County of Orange;
16 (a) deeds are growing which when mature bear wingy or
17 downy seeds, which will attain such a large growth as to
181 become a fire menace when dry, or which are otherwise
19 noxious or dangerous;
20 (b) Dry grass, stubble, brush, garden refuse, litter,
21 or other flammable material which constitutes a fire hazard
22 or which, when dry, will in reasonable probability constitute
23 a fire hazard;
24 (c) Poison oak and poison ivy which constitute a menace
251 to the public health;
26 (d) Rubbish, refuse and dirt upon parkways and side -
27 walks, and rubbish and refuse upon private property;
28 and
29 WHEREAS, in the judgment of the City Council said con -
30 ditions constitute a public nuisance and should be abated as such
31 pursuant to the provisions of Chapter 10.48 of the Newport Beach

1 NOW, THEREFORE, BE IT RESOLVED:
2 SECTION 1, The City Council hereby determines and
3, declares that the weeds and other conditions described above which
4 exist upon the streets, alleys, sidewalks, parkways and private
5 property within the City are a public nuisance.
6 SECTION 2. Said public nuisances must be abated by the
7 destruction or removal thereof, and all owners of property on
8 which such public nuisances exist or which abuts public streets
9 or sidewalks on which such public nuisances exist shall without
10 delay destroy or remove all such public nuisances or such work
11 will be done by the City, in which case the cost of such work
12 will be assessed upon the lands from which, and /or in the front
13 1 and rear of which, such nuisances shall have been destroyed or
14 removed.
is SECTION 3, The City Council does hereby set the 13th
16 day of March, 1967, at 7:30 o'clock P.M. as the time, and the
17 Council Chambers in the City Hall of the City of Newport Beach as
is the place, for hearing objections and protests to the proposed
19 abatement of such nuisances.
20 SECTION 4. The Fire Chief is hereby directed to give
21 notice of the passage of this resolution, of the Council's direc-
22 tion that such public nuisances must be abated by the destruction
23 or removal thereof, and of the time and place set for the public
24 hearing to consider protests, in the following manner:
26 By publishing the form of notice set forth in Section
26 10.48.040 of the Newport Beach Municipal Code at least twice in the
27 official newspaper of the City, the first publication of which
28 shall be at least ten days prior to the time fixed by the City
29 Council for hearing objections, and by mailing at least ten days
30 prior to the time fixed by the City Council for hearing objections
31 a postcard giving notice of the time, place and purpose of the
3,a hearing to consider protests to all owners of real property subject

to assessment for the abatement work directed to the address of
said owners as shown on the latest County tax roll.
ADOPTED this 14th day of February,, 1967.

duly and regularly adopted, passed, and approved by the City Council of the
City of Newport Beach, California, at a regular meeting of said City Council
held at the regular meeting place thereof, on the 14th day of February , 1967,
by the following vote, to wit:
