RESOLUTION NO. 6663
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH REQUESTING THE ORANGE COUNTY LOCAL
AGENCY FORMATION COMMISSION TO RECONSIDER THE
COMMISSION ORDER PERTAINING TO PROPOSED ANNEXATION
PROCEEDINGS DESIGNATED MODEN ANNEXATION - BOUNDARY
OR NO. 59
WHEREAS, at a regular meeting held on the 9th day of
October, 1967, the City Council adopted Resolution No. 6662
entitled t°A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEW-
PORT BEACH CONSENTING TO THE COMMENCEMENT OF ANNEXATION PRO-
CEEDINGS PURSUANT TO THE INHABITED TERRITORY ANNEXATION ACT OF
1913 TO BE KNOWN AS ANNEXATION NO, 59 "; and
WHEREAS, the City Council determined that the north-
west boundary of this annexation should be coincident with the
northwest curb line of Tustin Avenue between Emerson Street and
Francisco Drive, and should be coincident with the centerline
of Tustin Avenue between a point 330 feet north of Francisco
Drive and 22nd Street; and
WHEREAS, the County of Orange Local Agency Formation
Commission, at a regular meeting held on the llth day of October,
1967, approved the proposed Annexation No, 59 conditioned upon
the northwest boundary of the annexation being made coincident
with the southeast line of Tustin Avenue; and
WHEREAS, the City Council has determined that with the
northwest boundary of this annexation being made coincident with
the southeast line of Tustin Avenue, an unincorporated corridor
of land, measuring 60 feet in width and 610 feet in length, has
been created; and
WHEREAS, Section 35002.3 of the California Government
Code prohibits the annexation of territory to a city if as a
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that it hereby requests that the
result of
such
annexation a
strip
of unincorporated
territory
less than
200
feet wide and
more
than 300 feet long
is created;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that it hereby requests that the
County of Orange Local Agency Formation Commission, at its next
regular meeting, reconsider Condition Number 1 in its order
approving proposed annexation designated Moden Annexation -
Boundary No. 590
