HomeMy WebLinkAbout6669 - No Parking Area on PCHmec .. 1/7/67 (12) it I 1 RESOLUTION NO, 6669 21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ESTABLISHING A NO °PAMCING AREA ON 31 A PORTION OF PACIFIC COAST HIGHWAY 41 51j WHEREAS, Section 12.40,160 of the Newport Beach Municipal 6 Code provides that the City Council may by resolution establish no- 7 parking areas and, when appropriate signs or markings are in place, 8 I no person shall stop, stand, or park a vehicle in the no- parking 9 area so established; and 10 WHEREAS, Section 22506 of the Vehicle Code provides that 11 local authorities may by resolution prohibit the parking of vehicle. 12 on a state highway if such resolution is first submitted to and 13lapproved in writing by the Department of Public Works; and 141 WHEREAS, the southerly side of Pacific Coast Highway 15 beginning at the westerly city limit and extending easterly to a 16 point 300 feet easterly of 60th Street is an area where parking 17 should be prohibited in order to facilitate the flow of traffic 181and eliminate traffic hazards; 19 NOW, THEREFORE, BE IT RESOLVED that the southerly side 201of Pacific Coast Highway beginning at the westerly city limit and 21 extending easterly to a point 300 feet easterly of 60th Street is 22 hereby designated as a no- parking area. 23 BE IT FURTHER RESOLVED that the City Traffic Engineer is 241authorized and directed to sign and mark said area indicating that 25iparking I is prohibited as provided in Section 12,40,160 of the 26 Newport Beach Municipal Code, 27 Any provision of this resolution which regulates traffic 28 or delegates the regulation of traffic upon state highways in any 29 way for which the approval of the Department of Public Works is 30 required by state law shall cease to be operative six months after 31 receipt by the City Council of written notice of withdrawal of 3$ approval of the Department of Public Works. 0 R l 2 3 4 5 6 1 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Whenever this resolution delegates authority to a city officer, or authorizes action by the City Council to regulate traffic upon a state highway in any way which by state law requires) the prior approval of the Department of Public Works, no such officer shall exercise such authority nor shall such action by the City Council be effective with respect to any state highway with- out the prior approval in writing of the Department of Public Works when and to the extent required by the Vehicle Code.
