HomeMy WebLinkAbout6709 - Moden Annexation 59TLW:aem 2/23/68 RESOLUTION NO. 6709 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING ITS INTENTION TO CALL A SPECIAL ELECTION IN CERTAIN INHABITED TERRITORY CONTIGUOUS TO SAID CITY PROPOSED TO BE ANNEXED THERETO, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS RESIDING IN SAID TERRI- TORY THE QUESTION WHETHER OR NOT SAID TERRITORY SHALL BE ANNEXED TO THE CITY OF NEWPORT BEACH, AND FIXING A TIME AND PLACE WHEN AND WHERE ANY PERSON OWNING REAL PROPERTY WITHIN SUCH TERRITORY MAY APPEAR BEFORE SAID CITY COUNCIL AND SHOW CAUSE WHY SUCH TERRITORY SHOULD NOT BE SO ANNEXED WHEREAS, on February 13, 1968 the City Council received a petition signed by more than one - fourth of the qualified electors residing in the Moden territory, containing a description of the new territory proposed to be annexed and asking that the territory be annexed to the City of Newport Beach; and WHEREAS, the City Clerk and the Registrar of Voters for the County of Orange have checked the petition for compliance with the annexation and election laws and have each certified the suf- ficiency of the petition; NOW, THEREFORE, BE IT RESOLVED that it is the intention of the City Council of the City of Newport Beach to call a special election to be held on the 18th day of June , 1968, in certain inhabited territory contiguous to said city, pro- posed to be annexed thereto, for the purpose of submitting to the qualified electors residing in said territory the question "whether or not said territory shall be annexed to, incorporated in and made a part of.the City of Newport Beach with the property in the ter- ritory being subjected to taxation after annexation equally with property presently within the City of Newport Beach in order to pay the entire bonded indebtedness of the City of Newport Beach outstanding or authorized at the date of the first publication of the Notice of Election for Annexation, for the acquisition, con - struction, or completion of municipal improvements ". The specific description of the boundaries of said territory to be annexed is attached hereto marked Exhibit "A" and by reference thereto made a part hereof. BE IT FURTHER RESOLVED that said territory hereby is designated and identified for such election purposes and for use upon the ballots at such election as "Moden Annexation No. 59" BE IT FURTHER RESOLVED that notice is hereby given that on the , 25th day of March , 1968, at the hour of 7 -30 P.M,, in the Council Chambers of the City Hall in the City of Newport Beach, any person owning real property within said territory so proposed to be annexed and having any objection to the proposed annexation may appear before said City Council and show cause why such territory should not be so annexed. Such protest must be in writing and shall state the name or names of the owner or owners of the property affected by such annexation and the location and area of such property in general terms. If it be found that a majority protest has not been made as prescribed in Section 35121 of the California Government Code, further proceedings shall be taken in accordance with the,law for the holding of such special election, BE IT FURTHER RESOLVED that the City Clerk shall.certify to the adoption of this resolution and cause the same to be pub- lashed in the Newport Harbor Ensign once a week for the two weeks prior to the said hearing.
