Home My WebLink About6712 - West Santa Ana Heights Annexation 60TLWoaem 3/6/68 RESOLUTION NO. 5112 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH MAKING APPLICATION TO THE COUNTY OF ORANGE LOCAL AGENCY FORMATION COMMISSION FOR ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF NEWPORT BEACH WHEREAS, an application for an annexation of a parcel of land to the City of Costa Mesa has been submitted to the County of Orange Local Agency Formation Commission by the City of Costa Mesa; and WHEREAS, the area proposed to be annexed by the City of Costa Mesa contains 28.4 acres contiguous to the City of Costa Mesa, a part of which area contains approximately 13 acres of unin- corporated territory bounded on the north by Palisades Road, on the east by a line intersecting with Palisades Road at a point 141009 feet east of Santa Ana Avenue and proceeding south to the Orange County Flood Control District channel, on the south by the Orange County Flood Control District channel, and on the west by Santa Ana Avenue; and WHEREAS, the Local Agency Formation Commission has given notice of its intention to conduct a public hearing on March 13, 1968 on the application for the proposed annexation to the City of Costa Mesa; and WHEREAS, on April 19, 1967, pursuant to a request of the Local Agency Formation Commission, the City of Newport Beach advised the County of Orange of its contemplated areas of future annexation, which included that area presently being proposed; and WHEREAS, the City Council of the City of Newport Beach on January 22, 1968 directed the Planning Commission of the City of Newport Beach to study an area of approximately 540 acres located northerly of the present city boundaries of Newport Beach for its recommendations concerning possible future annexation; and WHEREAS, the area which has been under study by the Planning Commission includes as a part thereof a portion of the area proposed to be annexed by the City of Costa Mesa; and WHEREAS, the Planning Commission of the City of Newport Beach has studied and recommended to the City Council an area designated as_West Santa Ana Heights for proposed annexation to the "B:', respectively, and by reference thereto made a part hereof; and WHEREAS, the City Council has reviewed and considered the recommendations of the Planning Commission as well as the proposal of annexation to the City of Costa Mesa; and WHEREAS, the City Council has determined that the annex- ation proposal of the City of Costa Mesa is inconsistent with sound planning practice and not in keeping with the fundamental objectives of the Local Agency Formation Commission; and WHEREAS, the proposal of the City of Newport Beach con- stitutes a logical extension of the City boundaries as the initial phase of an'overall annexation program for the Santa Ana Heights area; NOW, THEREFORE, BE IT RESOLVED that the City Council hereby requests the County of Orange Local Agency Formation Commis- sion to review and approve the annexation to the City of Newport Beach of that certain unincorporated territory, designated as West Santa Ana Heights Annexation No. 60, and more particularly described by Exhibits "A" and "B" attached hereto. BE IT FURTHER RESOLVED that the City Council urges the County of Orange Local Agency Formation Commission to deny the application of the City of Costa Mesa to annex that parcel of unincorporated territory located easterly of Santa Ana Avenue, southerly of Palisades Road, and northerly of the Orange County Flood Control District channel, or to continue the matter without decision to the next regularly scheduled meeting of the Local Agency 2.
