A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF
A QUITCLAIM. DEED RELEASING THE CITY'S INTEREST
IN A STORM DRAIN EASEMENT OVER A PORTION OF
LOT 6, TRACT 5854
WHEREAS, construction of a new storm drain system is
required under the conditions of Use Permit No. 1396 granted to
KENNETH W.. McCULLOCH in connection with the development of Lots 6
and 7 of Tract 5854; and
WHEREAS, an agreement providing for the construction
of said new storm drain system has been entered into between the
City of Newport Beach and Kenneth W. McCulloch, and the necessary
grant of easement from Kenneth W. McCulloch has been accepted by
the City of Newport Beach and recorded as Document 941 in Book 9112,
page 884, Official Records of Orange County; and
WHEREAS, by reason of the construction of the said new
storm drain system, the City Council has determined that there is
no further public need for the existing storm drain easement,
legally described as;
That 101 wide easement to the City of Newport Beach
for storm drain purposes over a portion of Lot 6
Tract 5854 as shown on a map recorded in Book 213,
page 39 of Miscellaneous Maps, Records of Orange
County, California;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the Mayor and the City Clerk be
and are hereby authorized and directed to execute a quitclaim deed
to the owner or owners of record, releasing the City ®s interest in
and to the following described storm drain easement;
That 101 wide easement to the City of Newport Beach
for storm drain purposes over a portion of Lot 6
Tract 5854 as shown on a map recorded in Book 211,
.� page 39 of Miscellaneous Maps, Records of orange
County, California;

BE IT FURTHER RESOLVED that the City Clerk is hereby
directed to cause said quitclaim deed to be recorded in the
Office of the Orange County Recorder,
