HomeMy WebLinkAbout7400 - Vacation & Abandonment of AlleyRESOLUTION NO. 7 4 0 0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING ITS INTENTION TO ORDER THE CLOSING UP, VACATION AND ABANDONMENT • OF AN ALLEY IN THE CITY BLOCK BOUNDED BY PACIFIC COAST HIGHWAY, DAHLIA, THIRD AND FERNLEAF AVENUES The City Council of the City of Newport Beach, pursuant to the provisions of the "Street Vacation Act of 1941" and all amendments thereto, being Sections 8300 to 8331, inclusive, of the Streets and Highways Code of the State of California, does HEREBY RESOLVE AND DECLARE as follows: SECTION 1. The public interest and convenience require the closing up, vacation and abandonment of a. certain alley in the City block bounded by Pacific Coast Highway, Dahlia., Third and Fernleaf Avenues in the City of Newport Beach, and it is the intention of the City Council of the City of Newport Beach to order the following described alley in the City of Newport Beach, County of Orange, State of California, to be vacated, closed up and abandoned, to wit: That portion of Lots 12 and 14 in Block 632 of the Corona del Mar Tract per map recorded in Book 3, pages 41 and 42 of Miscellaneous Maps in the office of the County Recorder of Orange County, California., together with that portion of the 14.00 -foot alley in said Block 632, described as a whole as follows: Beginning at the intersection of the southeasterly line of Dahlia Avenue (formerly 31st Avenue) as shown on the map of said Corona del Mar Tract with a line which is parallel with and southwesterly 36.00 feet from the northeasterly line of the 14 -foot alley shown in Block D on the map of Tract No. 323 recorded in Book 14, page 40 and 41 of said Miscellaneous Maps; thence S. 39 1383 W 14.00 feet along said southeasterly line of Dahlia Avenue; thence parallel with said northeasterly line of the 14 -foot alley S. 50 °22= • E 98.00 feet to the beginning of a tangent curve concave westerly and having a radius of 20.00 feet; thence southerly 31.42 feet along said curve through a central angle of 90 °00100" to the point of tangency with the southeasterly line of said Lot 12, said southeasterly line being the northwesterly line of said alley in Block 632; thence S. 39 038100" W 154.00 feet along said northwesterly line of said alley to the most southerly corner of Lot 2 Block 632; thence S. 50 022300" E 14.00 feet to the most westerly corner of Lot 1 said Block 632; thence N. 39 038100" E 177.86 feet along the southeasterly line of said alley in Block 632, to the most southerly corner of Lot 3, Block D, Tract 323; -1- i • t thence N. 17 °30356" W 18.69 feet to said line being parallel with and southwesterly 36.00 feet from the northeasterly line of said 14 -foot alley shown in Block D, Tract No. 323; thence N. 50 122' W 116.30 feet along said parallel line to the point of beginning. The said alley to be vacated, closed up and abandoned is more clearly shown as Parcel 2 on a certain map approved and adopted by the City Council of the City of Newport Beach for said vacation, closing up and abandonment, by resolution dated April 12 , 1971, and designated Resolution No. 7399 , which said map is on file in the office of the City Clerk of the City of Newport Beach. Reference is hereby made to said map for further particulars as to the proposed vacation, closing up and abandonment of said alley, and said map is made a part of this resolution by this reference to the same extent and purpose as if it were incorporated herein in full. SECTION 2. The proceedings for the closing up and abandonment of the aforesaid alley shall be had and taken, and the City Council of the City of Newport Beach hereby elects to proceed under the provisions of the "Street Vacation Act of 1941 ", and all amendments thereto, being Sections 8300 to 8331, inclusive, of the Streets and Highways Code of the State of California. SECTION 3. The Street Superintendent of the City of Newport Beach shall cause to be conspicuously posted along the lines of the said alley proposed to be vacated not more than 300 feet apart, but not less than three in all, notices of the vacation of said alley. Said notices shall state the passage of this resolution of intention and the time and place of the hearing of all persons interested in or objecting to the proposed vacation of said alley. Said notices shall be so posted at least ten days before the date of said hearing, all as required by law. -2- SECTION 4. There is hereby reserved and excepted from the vacation of said alley a permanent easement for public utility purposes over and across said alley proposed to be vacated. These vacation proceedings are taken subject to the reservations and exceptions herein contained. SECTION 5. Notice is hereby given that the City Council of the City of Newport Beach does hereby fix Monday, the 17th day of May 1971, at the hour of 7:30 p.m. of said day, in the Council Chamber of the City of Newport Beach, located in the City Hall, as the time and place for hearing all persons interested in or objecting to the proposed vacation of said alley, and the City Council at said time and place will hear the evidence offered by any person interested in the vacation of said alley hereinbefore described. SECTION 6. This resolution of intention shall be published at least once in the official newspaper of the City, and said publication shall be made before the date set for the hearing of all persons interested in or objecting to the proposed vacation.
