A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ADDING SUBSECTION 507.10 TO
SECTION V OF PERSONNEL RESOLUTION NO......722.6
RELATING TO SPECIAL COMPENSATION.PROVISIONS
WHEREAS, Section V of Resolution No —.7226 .sets out
Special Compensation Provisions; and
WHEREAS, the City Manager has recommended—that—.a—new
subsection relating to witness fees be'added.to..said..Section V;
NOW, THEREFORE, BE IT RESOLVED _.that_.effeative
April 12 , 1971, subsection 507.10.1s_.added to Section V
of Resolution No. 7226 to read:
"507.10 Witness Fees
No deduction shall be made in the'salary of an employee
who is subpoenaed to testify in a judicial or quasi -
judicial proceeding as a material or expert witness if
he waives or remits to the City any fee received for
being a witness. If the employee chooses to retain
the witness fee he will be charged compensatory time
off, vacation time or leave without pay, accordingly
for the time spent testifying. If the employee incurs
personal mileage expenses while appearing as a witness,
he may retain that portion of the witness fee attributable
to mileage and remit the difference to the City.
An employee subpoenaed to appear pursuant to an official
subpoena shall immediately notify his department head
and indicate whether he will remit the witness fee to
the City or retain it and take either compensatory time
off, vacation time, or leave without pay."
ADOPTED this 12th day of April , 1971.
